Hi-
I rec'd an email form Integrity advance, with whom I'm trying to settle with.. they are unlicensed in the state of WI, and say I owe a balance of $810 on a $500 loan! I paid back $300, so I should only owe $200 if they are unlicensed in WI, right? They state in the email that they will settle for $350 as long as I comply w/thier settlement offer which os to provide copies of my complaints and that I must not discuss w/a 3rd party or they can liquidate me for damages up to $10,000.00.. is this legal????? any help is much appreciated..

Well the settlment they are proposing is unacceptable. You owe $200 and that is it. They are not licensed in your state.

As for the documents they are trying to have you sign, that is a settlement agreement most PDLs are using now. It typically is a way of trying to buy your silence by agreeing to your settlment terms. However their $350 proposal is bogus! Send them a counter offer for $200, and reinterate they are unlicensed in your state.

Yes, it is.. I read over the settlement and it doesn't even have my original loan amount on there! It states that it is "highly confidential" and that I am not allowed to discuss w/anyone.. I sent them back an email stating they are unlicensed and that my balance is only 200.. do I have to provide them w/copies of my complaints? I did the one for WDFI online.. Not sure how to do it w/the WI AG..

The first thing I would do is respond that they are unlicensed in the state of WI which make it illegal for them to loan to residents of WI.

You owe them $200 and make sure they know that is ALL you are willing to pay back. You don't have to give them jack or settle for anything other than $200 and they know it.

I reec'd this respose back from Integrity advance..
Hi Rebecca, the position of the Wisconsin Department of Financial Institutions is that loans can be made to Wisconsin residents as long as the lender does not solicit the borrower. Due to the fact that we do not solicit residents of Wisconsin, we are not required to obtain a license in Wisconsin. In spite of these facts, we are still willing to release you from your $810 balance upon receipt of $350 & satisfactory evidence that your complaints have been resolved.??

Does this mean that they are legal and I have to pay them the $350 and not the $200 which is really what I owe??

Not based on what the WDFI told me when I was looking at adding an internet option in WI.?? Thier words, "you must have a license to lend".?? That means either a storefront with a license and internet loans processed from that location or a seperate license for the processing location.??
If you look at thier list of lenders, companies such as Check Into Cash have a seperate license for thier internet lending since they are processed in TN.

Takes them awhile (I believe it can take up to a month for them to get back to you) Though usually for me it has been a few weeks. If you provided a e-mail address sometimes they will e-mail you if they have further questions once they get your complaint.??


In the mean time just keep reminding Integerity that they are unlicensed in the state of WI.
