Please help me. This is in regards to Emerald Marketing Group. I got an online payday loan back in July 07. The check ended up bouncing months later and then in January, I got a call from a woman demanding payment. At the time I owed $350.00 on a $200.00 loan. She offered to do a settlement with me of $150. That same day I did a MoneyGram and sent the money. A few days later I rcvd an email confirming receipt of the payment and a settlement letter, advising me that I was released from all responsibility with the settlement. Then back in early March I rcvd a call from the same woman, saying that she had garnishment paperwork for me on her desk. I refreshed her memory that I paid this off and she told me not to worry about it, and that she would take care of it. Then last night I rcvd an email stating that I was refusing to cooperate and that I NOW OWE $401.67. I responded back and then called. She is now telling me that the settlement was only to cover the loan not the NSF fees and that 28% interest is being added every day to the amount owed. If this was the case, why didnt I hear about this before? I asked her to send me something in writing (which they have never done - apparently they only do business via email and fax)and she said that she doesnt have to do that. I am so freaked out and angry. She is threatening to garnish my wages and take money out of my accounts. What do I do? I just want this to be over and I feel like they are just trying to get more money out of me. Please help me. I am so lost.

First of all, your anger is pretty justified. These people are frustrating...if you throw a search in this site with the company name, you'll be hit with numerous threads, where people have commented against them.

Don't hit the panic button, its very important that you keep your cool while dealing with them. Most likely, all these are fake threats and they can't garnish your wage, for that they need to get the judgment against you.

Just hang around, others will shortly come to help you out.

To Michelle.
I hope you are still not dealing with this but if you are have have some advise I think may help you. Rest assure Emerald Marketing Group LLC. CANNOT Garnish your wages !
this is a sick and twisted scare tacit. The fact that you were advised $150.00 would settle your account & now they wait to come back at you to tell you owe money for NSF is an error on there part they should have all there ducks in a row before even offer you a (settlement offer) Also it seems like they are trying to bully into paying them more money. Now it's time for you to turn the tables on them. One thing they cannot stand more they not getting paid is a person who knows what they are talking about. on your computer I want you to type in your search engine pay day loan in (what sate you live in) then type are they legal the reason why is there are 12 sates out there which pay day loans are (not legal) it consider loan sharking. Then put in a complaint with your states BBB, and the FDCPA Then your next step is if you still have your e-mail letter stating you settled in full or your account has been settled print it out save a hard copy and soft for your records. Mail a copy to Emerald Marketing Group LLC

along with a letter you will want to type up the letter it should read (Only type in the below statement if you find it's true and Emerald Marketing is not authorized to operate in the state of (which you live in.

Per the State Attorney General's office, it is a fact that regardless of where you are located, according to (which ever state you live in) law Emerald Marketing is not authorized to operate in the state of (which ever state you live in). NOTE: Plus save copy of the letter you are going to type to them. (Also send the letter to them by certified register mail. This way you will receive receipt of who signed for it. There address is all over the Internet. you can search this.
Also state you are formal notifying Emerald Marketing Group LLC to cease and desist all communication at once with you. This should work for you any more issues let me know I will see what I can do.

I'm getting the same threats as other people here.. They are threatening me for internet fraud and "bad checks" just because they deposited $200 in my account and my bank account was closed by the banking institution.. It was out of my control that they closed my account but they're saying I've committed fraud and that I have a judgement out, and if I don't pay a settlement, they will garnish my wages. However I live in NJ where payday loans are illegal. Will my wages be garnished by this company?

I received a phone call from Emerald, threatening garnishment of my wages. I am not sure if I ever even received a payday loan from them in the first place. According to them, I did almost 5 years ago. Again, I am not sure. However, I work for attorneys and checked with my boss. We are looking into pursuing our own claim against them. I am not sure what the legal basis is, but my boss and another attorney seem to think they have a pretty good legal argument. No matter what the case, these people are dirty, low-down liars.
