I had a great conversation with Attorney Arthur Levy, who is working on the cashcall lawsuit in California. I also invited him to visit the forums, which I certainly hope he does and welcome him.
Here is what I can say on the lawsuit in a nutshell from Arthur: it is being filed in Los Angeles County and concerns CC's lending practices, specifically interest rates, fees and CC's practice of debiting on days that weren't agreed on by the consumer. Also they are looking at CC's charging bounced check fees that are higher than California state law allows. And more importantly, they are working to see that Cashcall doesn't engage in harassing activities.
Arthur agreed to let me give his contact information, but wants it in a PM to individuals, due to the volume of calls he could get.
He said that he would be willing to help if someone is facing an extreme situation with CC right now.
I told him that I am ready to sign on in the battle and know that many other members of the community would too!


I received a card from the court about this lawsuit. Do you know if there's some kind of settlement . I would like to know if the trial is over and when I will get any information about the this lawsuit.

I am stuck in this loan also I have been paying on this loan longer than a year and owe more than the loan was...The worst decision I have ever made...I have never been late on any payments but can't afford them anymore due to a decrease in hours at work...I can't believe I will pay 14 thousand on a 2600 loan what a crock....Please help

That's great news!! Such 'CC nightmares', on this forums. I'm just glad I no longer have to deal with them anymore. I know that info will be SOOO helpful with others.

YES! I hope to see this horrible company go down in flames. (Not literally, of course, God forbid someone think I was threatening them...that might be a little too much like what they do to their clients!)

I don't have, and never had a CashCall loan. I just know from all the horror stories on our site (and others - check out ripoffreport.com) that they have a terrible reputation with the general public.

Quick update: I sent out my C and D letter and 1 day letter got another call from them. I had also spelled out in my letter my repayment schedule for this month. When I called CC back to blast them, the letter was in my file and the rep I spoke with literally yes, Maamed me all over the place. He agreed with everything I said and actually apologized for the harassment I had gotten over the phone. I actually told him that it was phone terrorism and asked him how many times a caller had to tell a CC rep something before it stuck.
The upshot is that we agreed that CC would act professionally towards me and I would not tolerate any more rudeness from them over the phone. Now we shall see what happens next, right?

I live in the State of Georgia, I'm stuck with a cashcall loan, the interest rate is too high and they will not work with me, they keep changing my due date
so they can collect late fees, I had the option of changing it to the 15th of the month, which they agreed, now they have changed it back to the first, because I chose to mail my payment and not let them debit my checking account every month.

Can you help me with my cashcall loan. I am one month behind on my payments with cc and they are harassing me by phone, email, and have just sent a fax to a public work fax machine threatening to garnish my wages. I am very upset and embarassed....

I turned my Cash Call Loan over to Town & Country. I had never been late on my loan before but everything else was being paid by T&C so I thought they may as well handle this too. T&C was not able to hit my due date with the payment, they would be paying late. I informed Cash Call right from the beginning that I had already notified the AG in PA and in CA, as well as the Banking Commissioner in both states. I let them know that any kind of antics would not be tolerated. They were not to call me at work and only on the phone number that I provided. They did try to call and tell me that they would not accept a payment from T&C but they changed their mind when I told them that it was not stated anywhere in the contract that they would not accept a third party payment. They have been very respectful and asked when they could expect their payment, I gave them the date and they have taken me off of the automatic calling system until the payment is received. Isn't that amazing!

I have been harrassed by Cash Call for the past three months trying to resolve a deliquent payment issue. I fell behind in July by one payment and to this day, Cashcall has been nothing but trouble. They have tried to debit my account without my authoirization more than a dozen times, threatened and yelled at me over the phone and I am just sick of this! They want me to defer the payment but I refuse to do so. THey have charged me outrageous fees because of this and still coninue to debit my asscount when they feel like it. I had never been late paying them before and to date they continue to hit my bank account when they feel like it. I don't know what else to do, but I would like some legal advice with this matter, I want to participate in the class action lawsuit once it's filed they need to be stopped for deceptive business practice as well as fraud!

Send me a PM with your information and I will send you the contact information on the attorney handling this in California. Basically, the suit involves CC's practice of debiting accounts on days not agreed on by the consumer and other matters.
The other thing I would recommend you do immediately is send them a cease and desist letter, stating the following:
1. Your repayment plans
2. Under no circumstances are they allowed to call you 24-7 and harass you like they have been doing.
3. You can designate how they can contact you, whether it be another phone number or in writing.
I faxed mine to two fax numbers they have on their website and mailed it to them as well--and two days after they got it, I got a very apologetic call from a CC associate, saying they had some "Bad Apples" in the bunch. Gee, ya think, lol?? :evil:
The main thing is, stick to your guns. You and I owe the money, we both know that--but that doesn't give them the right to make our lives a living hell. So if they do call and go off, then the call is ended, right?

I have decided to take the attorney up on his offer to help me locate a lawyer here. I set up a payment arrangement to pay them yesterday becuase I did not pay. They called me 7 or 8 times a day. Finally I called them and asked why they keep calling me and they claimed it was the automatic dialer..I told them no, that humans were calling me to and it needed to stop or I will report them. She apologized and said they noted my account...not five minutes after I hung up with her I was called. I am done!!!

Yep...Cash Call is HORRIBLE when they talk to people. Even though my loan was 'sold' to someone else, Cash Call still tries to call me on occasion. I know this is probably a long shot, BUT..does anyone know if people, that DO have Cash Call loans, can get them 'deleted' from their credit? What else does Arthur Levy office say about that ( removing Cash Call)?

I live in Colorado and my loan was at 99%, I became unemployed and all they do is call from the minute it turns 8am, sometimes even a couple minutes early. The worst part is that I get these nasty messages that they're from the corp office and demanding that I call by a certain time and that they have been unable to reach me. FUNNY! I call everyone of these idiots back, end up leaving a message. Then the next day, someone else calls me from corp on top of the auto dialer and the other employees. I just want to know if anyone knows what my recourse is in Colorado?

When you worked out the payment arrangement with them did they drop your intrest rate any or did they leave it the same? Mine will go in default in about a week, so I am wondering what steps I need to take, I am ok with making a payment arrangement, but I want to do everything by money order.

i have a question is there anyway to get ahold of this attorney. I am currently having a huge problem with cash call. number one being harrasing and making promises the have not kept false advertisement. we loan you money based on trusting you no credit check. which the first thing they do is check your credit. so I am trying to get in touch with an attorney on this matter so they will realize they are in the wrong. I noticed somebody is also have problems if there is any way I can get this attorneys number please give it to me I need to start resolving this issue as soon as possible.

I'm retired on a pension. About a year ago I had some temporary financial problems and contacted Cash Call abou a loan.....They told me that I couldn't get a loan in my name and my wife's name, which I wanted so they turned me down............Thank heavens for the denial.

I have a loan with them and I filed bankrupcy they still call me and I tell them I have filed but they will not take my case number they want me to fax all my paper work from my lawyers to them and until I do they will keep calling. They have called my reference twice a day Ihave called them and they will not take my lawyers number or case number isn't that illegal

I have filed bankrupcy and they still call they are also calling my referance's at least everyday I have tried to give them my case number and lawyers number they will not take it said calls will come everyday till I pay them off.
