They actually can file a complaint against you, Payday One is usually licensed to lend in all the states. Have you tried to work out a payment arrangement with them? Has this been sent to collections and have you received any documents from the collection agency?

Hmmmmmmm, Payday One isn't licensed in KY. Was this an installment type of loan, or a payday loan? If this is a payday loan, they can't really sue you as they aren't licensed in the state of KY. I wouldn't give them my debit or credit card number if I were you. Instead, I would ask them for an address you can send money orders via USPS. No, nothing from a collections agency. They actually stopped the ACH debits - not I. When they did that, I told them that I would be back in contact when I received the information from the Kentucky Attorney General (which I haven't yet). The first I have heard from them was this call. He couldn't even tell me it was from Pay Day One. He just said he was representing Nat. PDL in Deleware. When he finally gave me the balance I knew it was Pay Day One.

Here's an update on this . Apparently now Pay Day One is listing Kentucky residents under small term loans and not payday loans. So their contracts are valid.
