payday loan calls,,im scared

I got a call today from a place called Kaufman/Hines and associates.The guy said his name was Mr.Steven and that they were about to file court papers on me for fraud alligiatioins and thief by check for a payday loan.
he told me I could make a payment today and then 3 more payments to get my loan payed off.I told him I have no money right now and he said he would hold it off till friday but i had to go get a pre paid visa from walmart and make a payment.I told him maybe i could pay 200 on friday and he told me he would have to call his supervisior and try to get permission for that and he would call me back tomorrow.What do I do.alot of ppl have told me this is a scam and that this company is under investigation.Im scared and dont know what to do.I am a single mother of 2 kids at home and dont want to go to jail..Please any help i would so appericiate.

I did some research on the web because of a situation I was in, concerning PDL's. First of all, you need to find out if the PDL's are legal within your state..meaning if 'your' state allows PDL lending. Second, if the PDL IS illegal in 'your' state, then the (so-called) CA who is collecting for it is practicing illegal collections because they cannot collect for something that is illegal in the first place.
You cannot be arrested or go to jail for a PDL. ALOT of PDL's threaten that they will take you to court. If they are illegal, they can't do that. Hope the advice helps a bit.

did some checking of my own and this just another turdpile bottomfeeder that needs to use scare tactics.this waste broke the law with his call i these ways.

1)fraud,and theft are crimes and none apply to a pdl.
2)research shows no real info on this place.just more posts like yours.

here is what you do.file a police report as again the idiot broke the law with the call and threats.use any numbers and the name of the bottomfeeder to file AG complaints against them.then do not engage him further.he cannot and will not do a thing he threatened.just know that file the report and complaints.then ignore him,or hang up without a word if you get caught on the phone.a complete waste of your time to talk to a scamming idiot.

My payday loan is in Texas.I just recieved a call from my duaghter and she was frantic.They called her and told her I am about to be charged with faud and that I must contact them NOW.I tried to tell her not to worry but she said the guy said he was from a law firm and he sounded legit. I didnt think they could call my family and tell them my business like that.

They are using unscrupulous intimidation/bullying tactics in attempt to get you to cower before them and succumb to their every demand.

First of all - figure out whether or not the loan "provider" is legally licensed to conduct deferred deposit transactions in your State. If they are an online PDL, chances are they are not - but best to check with your State's Department of Financial Institutions just the same.

Assuming they are not, then the next step I would recommend is looking up your state's particular Financial Code relating to deferred deposit transactions. In MY State, California, there are sections specifically dealing with these types of loans - including regulation with regard to the maximum interest they are allowed to charge consumers of the State of California (were they legally licensed to perform such transactions in the first place). I do not know if your State's code has similar language, but it's most definitely worth the time/research so you can have ammunition to throw back in those bullying assclowns' faces.


Incidentally, you can do most of this research online via your State's government website(s).


If you are able to collect all of that legal/statutory information, THEN you have the ammunition to fire back at them with. Tell them that their client is not only NOT legally licensed to conduct these transactions with consumers of your State, but - even if they were - they are in violation of your State's regulatory maximums for interest/fees that can be levied upon you relating to such transactions. They will likely fire back with something like "you entered into an agreement and you should have known this, that and the other." IT'S IRRELEVANT - they are NOT legally licensed to conduct financial transactions within your State - period ... end of story ... goodnight and good luck.

If they continue to threaten you, tell them that if they do not cease and desist that your next call is to your State Attorney General's office to report both they and their client - as well as to the Better Business Bureau, your Congressional Representative and Senator and any/all applicable State and Federal Commissions.

My husband was contacted by these people... well your story sounds EXACTLY like his... he got as far as emailing a letter to these people giving them permission to charge his card almost $500 to avoid being arrested or sued. They had all of his personal information.
When I was about to email his mom for help... my husband told me this companies contact information and the email was a Gmail account. I questioned why a financial company had a gmail account and not a professional one... So I called the number that was on his cell phone and they answered very unprofessionally - not saying what the company was. After stating that I didn't believe they were a real company the lady hung up on me and refused to answer the phone several attempts after that. The next day my husband put a hold on his credit card while I sent an email stating they have to provide proof of a debt and that they were a legit company. We received no response from the email and 2 days later when they tried to take the money out and was declined, they called my husband and threatened to come and arrest him. The guy went as far to say he was a lawyer and gave his bar number.... I did verify that it was a valid bar number and the name matched up - but when I called the contact number on the Bar website - this man was NOT the same man who had been calling my husband. This guy sounded american, but the people who had been harrassing my husband had indian accents.. using plain american names like Jessica White and Kevin Smith.
I called the next day and told them that we will never pay them and that I KNEW they were scammers. They still call my husband both on his cell and at work... but he just keeps telling them - he will not pay until they provide him with proof. They just keep saying they will have some one "serve" us with papers. Well - that was a few months ago and we have yet to be "served".

Hope this helps & eases some concerns. Just ask for them to provide an address to mail a money order to and that will end that call.

Thisis a scam! do not pay these people a dime.They are running an internet fraud and have stolen the infor from a sight were you may have filled out a payday loan app.
