Last year I took out a payday loan for $200 from Kenwood Services. After making one payment on it I discovered it was an illegal payday loan (I live in NH) and closed my account. Today I received a call from Francis, Edwards & Associates saying that they are now in pre-litigation and that I need to set up payments today for this past due amount (now $450 because of fees, etc) or I will end up going to court for wage garnishment. Now I informed the gentleman who called me that I found out this was an illegal payday loan and that's why I closed my account, he says that unfortunately since it's not within 30 days of when the original paperwork was sent out by them (which I never received by the way) I can not contest this and it is considered valid. Is he correct? Do I have no options here? Please, any help, suggestions or advice would be greatly appreciated.

The way in which the caller threatened you is a violation of the FDCPA rules. You can file a complaint against them with the FTC for this.

Thank you so much for you help everyone :-) He didn't say it in those exact words, just said that if it was handled today that he would be sending a VOE to my employer and then I would have to go to court for the wage garnishment. Will asking for Debt Verification stop them from sending a VOE to my job? I just don't want to go to court for this stupid thing. He said that they had already contacted my previous bank who verified that the loan was deposited and after one payment the account was closed. Is this legal? Can the bank disclose that information without having me on the line even though the account is closed? Also, am I understanding that if it's an illegal payday loan that it's illegal for them to try to collect on it? Or am I misunderstanding?

Sorry, but I've never dealt with anything like this before and even though the guy was super nice about the whole thing (acting like he was doing me these favors and "going off the record" etc) it still has me nervous. He even spoke with my manager before he spoke with me but wouldn't really go into any details with my manager luckily. I just want to make sure that I handle this the best way possible, especially since this guy told me that once it gets to this point that there isn't anything else I can do to fix this situation besides pay them.
