Paradise Cash Advance - My letter to them
Date: Fri, 07/20/2012 - 06:37
Taking the great advice from the experts here. I sent this email to Paradise Cash Advance and did get a notice they received it. I know my conscience is clean that I did the best I could to satisfy my commitment but I am kinda nervous about 'jabbing a stick in a bee hive'. You think this letter will suffice? Will this do anything to get collection attempts to stop? I know I did not include the other dollar amounts in the refund amount. I really do not care as long as this stupid thing will go away.
Dear Paradise Cash Advance,
In 2009 I had a loan in which I request the full amount be taken out the next payday. Loan 2200394. After many repeated ignored attempts the ACH was revoked under protection of Federal and Indiana law.
It had come to my attention that payday lenders must be licensed by the state of Indiana in order to offer loans to its residents. Since your company has no license in my state, the loan contract I had with you was not valid. Although I was not legally required to do so, I re payed the principal balance of this loan. To date, I received a deposit of $400 on 06/19/09, and have had 4 bi-weekly withdrawals of $100, 1 withdrawal $115, 1 withdrawal $105 debited from my account. This results in an overpayment of $220. I also paid your collections department $197 on November 20, 2009 and then a second payment of $319 on November 23, 2009. After repeated calls I was told I would get a Paid In Full statement that I never received. Now, I am getting collections calls once again and was told that I owe the full amount for the renewed account numbers of 2359392 and 2380425 which I was advised, once I protested those numbers, that once the loan renews it gets a new account number.
At this time I am requesting a return email acknowledging that my loan has been paid in full. Also, I would like a refund of the $220 overpayment. A refund check of $220 should be mailed to me at the address you have on file.
Please respond to this email with acknowledgment that my account has been satisfied in full and stop all collections attempts. Details of when I can expect the refund check, as discussed above, should also be included in the email.
Sincerely

I like your letter, although I'd ask for a FULL refund, including all the amounts you paid to the collections people too.
Keep at them. You're definitely on the right track.
