I am in over my head in pay day laons. I have the following loans and I need help.

I've been doing a search on Instant Cash 911 and keep coming up with Instant Cash USA, it makes me wonder if there is some connection there, I'm not quite sure but perhaps someone else can enlighten you on this company. Keep checking back, meanwhile, I will research the other lenders and see what I can come up with.

Nevada requires Internet based pdl's to be licensed by your state. I checked HERE and could not find a license for Lakota cash, therefore I would venture to say they are not licensed to lend to NV residents, which places them in the illegal lender category. In fact, I don't see any of yours in the licensee data base.

Keep checking back, there may be someone else with more info on these lenders, as far as I know, none of them are legal but I'm not 100% sure about that. I am sure about CashTransferCenters though, they are illegal, I would get my bank account closed asap if I were you, then follow the steps I gave you on how to deal with illegal lenders.

They can't garnish your wages without a court order, and if all these lenders are illegal as I suspect they are, they can't take you to court. They can however attempt to evoke a wage assignment, BUT, you have the right to revoke ANY wage assignment at any time. Just read through the topic I posted above, "How To Deal With Illegal Lenders, link below.

hello,i noticed you never stated how much was debited by each pdl.keep in mind that if a pdl is illegal all monies debited go toward the principle.example:

if you borrowed 300.00 from CTC they debit 4 times at 90.00
they debited 360.00.therefore you not only don't owe but they owe you 60.00.see how that works.try to find out what if anything was debited by each pdl.take that off the amount you owe.personally,i would do this on my own. to borrow a phrase...you can do it we can help.

They ended up garnishing my wages. They got their money and I kept proof of it. A 3rd party tried to collect on it after the fact, but I sent them all the proof they needed. I haven't heard anything since then. These online Pay Day places are not a good solution. Stay away from them!!

Tell them the world wide web does not make the contact legal and binding. The loan was illegal no matter what the contract says and the fact that it is illegal makes the contact void.

Do you owe them any money? Is so at this point you can walk away and never pay them as they can not take you to a legal US court but that you are willing to pay any balance owed on the principle.

Then you have way over paid.

Tell them that since you are a NV resident within the US that Federal loan laws apply which makes the contact void and the loan illegal and according to the US laws that you only owe the principle on the loan which is $300 and since you have over paid that by X amount of dollars that you are demanding a refund of that over payment.

Sometimes a refund demand at least gets you a PIF.

This is the next email I received after I sent the above referenced email. Please help on how to proceed.

Ms. Scanlan- I assure you that our loans are not illegal in the state of Nevada and you are correct that federal law applies to this loan which supercedes state laws in this matter. My suggestion to you would be to call us and make arrangements to payoff the principle and be done with the loan. I'm not trying to argue with you or say that you do not know what you're talking about because I'm sure you have done some research, but the fact remains that you are still under contract to pay this debt. I have three payday loans out. I have been able to settle with two of them. They were very friendly and helpful. They both set up a payment plan for me and made the payments small enough to make it easy for me. It really helps to call them and explain the situation your in.

I am having trouble with the 3rd one. This is the one I least expected to have the problem with. I have been calling them and trying to arrange a settlement price and a payment plan, but they wont budge. My borrowed amount was 400.00. I have paid about 200 interest already. The last balance I saw before they closed my access to their web site was 408.00. I had offered them 50.00 every other week until it was paid off and that they were to add no fees or interest. They disagreed.

They offered to let me pay 50.00 and then three payments of 147.00 to settle it.Does anyone think this is a fair deal or should I continue to try to settle it. That would make it a total of 491.00 plus the about 200 interest i paid already.

Can I get some advice please....

P.S. The company is PayDay Max.

Yes. Since they "claim" they are legal. Start out he email quoting their statement and then ask them to give you their license number as proof of their legal lending practices.

Then continue with the fact that you have over paid and that you want the PIF.

What state are you in? I believe that Payday Max is illegal everywhere.

drop9drop, Not only is Payday Max illegal everywhere but PDLs are prohibited in CT.

Any PDL you have is illegal.

How much have you borrowed and how much have you paid back including any interest fees or rollover fees?

You can tell them to shove it if you have paid the principle on the loan. They can't do a thing to you.

I am pretty sure I have paid them a little over 200 between the interest and roll over fees. Maybe more. As I stated a few threads back, My borrowed amount was 400.00. I tried to settle with them stating that I would pay back the 400.00 but no interest or rollover fees involed. I told them I would give them 50.00 every other week until the 400.00 was paid. The last time I called them and I talked to the same woman, she would not bend. She tells me that it would be turned over to a collection agency if we cant agree on terms.

Should I just tell them agree with my terms and email them a few things with it.....like the Ct. law....or what ever you tell me to do... Thanks again for the help....

You might have to mail it and/or fax it. I searched and it seems others have had the same problem with that email. That email is not set up to receive only to send.

Some good news. All three of my paday lenders have agreed to a payment schedule.

I find if you call them and at least make a attempt to make payments or arrange a payment plan they will work with you.

Only one company gave me a hard time until I told them about :

Attorney General
Federal Trade Commision
BBB
Dept. of Banking in my state.

Then they were very friendly and agreed. I didnt want to push it to that point but had to.

So I can say this web site has helped me so much and gave me a lot of knowledge. With so much knowledge here, I cant sink it in my brain fast enough.....lol

I just want to thank all involved in this web site for the help and responses that I recieved here.

I hope it can help the rest in need.....
