I evidently have a court date in South Dakota on Jan 24, 2012. Not sure what I should do now? I live in Ohio and have sent them the Ohio laws regarding Online Payday loans several times with the wage/account revocation statements.

they have to sue you in your county,town,village,or bourough.check your court clerk's website to confirm this is just them blowing smoke.btw was there a case number with that?if so use that,but just know this is a tribal lender.meaning they would not have a prayer in court.i'm betting that this is not legit at all.that being the case file all the complaints and use the infio soaplady provided.btw was this an email,or did they actually send something?if it was email i guarantee it's not legit.

yes the FTC is attempting to take action against these tribal lenders.now that doesn't change the fact like the site states.you must be sued in your county,town,village,or bourough.it is total BS what they sent via email as they never send a thing to anybody except wage assignments via the USPS,and the wage assignment never gets sent to the person who took the loan.only their HR/PAYROLL person.that is why we always advise to revoke any possible wage assignments as that is their only weapon once someone defaults.

The "papers" I received the cover page has a case number but everything is in the tribal court. There is no legal action in the district court. Not sure what that means legally!?!
I saw the federal case against them. My guess is this is how they are circumventing not having a court order for wage garnishments.
I called and spoke with the clerk at the tribal court. Appears I need to call Kayla at Lakota's customer service number to discuss this. No surprise there. If the case proceeds the clerk said I have to call in at the time on my notice to appear.
When I told I the clerk I lived in Ohio and explained our Online Payday loan laws and I had paid back the principle the clerk sounded like, "Not another one. I'm tired of this." Seems like she must be getting quite a few calls and realizes what Lakota is doing is not right either.
