Pennsylvania Law Firm Sues Internet Lenders

This add is from Craigs list. Maybe there is hope for the Keystone State.

The law firm of Dessen, Moses & Rossitto sues Internet payday loan lenders that charge exorbitant interest rates and fees in violation of Federal or PA laws for refunds of interest and/or fees paid. If you got a payday loan through the Internet that you think may violate the law, please fax details and relevant documents to 215-564-2879. I just was looking at there website, and I just don't see how they can win a case . . . .

What better defense is there then the pdl saying "I contacted your state's licensing board, and was told that I didn't need a license as long as I had a license from another state and was not physically located in PA." PA's Banking Dept has published several interpretative letters to this effect, and there are several payday loan companies that post these letters on their website where they would normally post a license.

Honestly, for those companies that are licensed in another state, I don't think it's fair. They did their due dilligence, and checked out the laws, and were told what they can and can't do by the proper agency.

My only guess is that this law firm is going after companies that are completly unlicensed. That is the only way they would be able to win the cases.

I jsut received an email back - This is what they are looking for:

I am aware of the Banking department letter. It is my belief that the Banking Department's position on licensing does not affect Pennsylvania's interest rate cap on the type of loans made by Internet payday lenders. I am particularly interested in speaking with people who have made loans from one of the following websites:

Quickest-Cash-Advance
MoneyByNow
Cash-Advance-PaydayLoan-to-1000.

I do not believe any of the lenders associated with these web sites are licensed in any state.

I would be interested in speaking with you if you have made a loan from any of these websites

Yes, it is only for people in PA. I asked him, and this was his response:

I am only looking for people who are residents of PA - not NJ. Let me know if you think I can be of assistance to any of your clients or if any of them might be interested in participating in litigation against any of of these lenders.


Anyone is PA with loans from any of the lenders posted above should call them and see what they can do for you.

I wouldn't be so sure. You get the case in front of a jury, the PDL people will lose.
