Hello everyone!
I posted this under Anonymous earlier, but now I don't see the thread, and this was before I read the "Read Here Before Posting in this Forum" thread. Now I am ready to go!
I came across this forum yesterday, I closed my bank account and sent emails today. Now, I'm nervous, because I just realized that the thread I was following was started in 2009, and I'm wondering if legislation has changed.
I have a total of 12 payday loans (I know, I'm an idiot). They are as follows:
500Fast Cash - Borrowed $400 - Paid $0 (first payment due 8/17)
QXL Online - Borrowed $200 - Paid $237
First American - Borrowed $200 - Paid $465 (last payment would have been 8/17 for $65)
Holiday Group - Borrowed #300 - Paid $540 (when contacted, they said they would consider my account settled)
Bottom Dollar - Borrowed $300 - Paid $270
Archway - Borrowed $300 - Paid $450
Ameriloan - Borrowed $300 - Paid $270
Kemper - Borrowed $300 - Paid $360
Sure Advance - Borrowed $400 - Paid $318 (responded to my email quickly, told me they would settle for $506 - the principal plus one additional "renewal" fee
Cash Direct Express - Borrowed $600 - Paid $318
Everest - Borrowed $300 - Paid $0 (first payment due 8/17)
I know that I have been foolish, and I'm more than willing to pay my debts, but at this point, I have been paying almost 1,000 every pay period, which is leaving me with nothing to live on. Which, in turn, resulted in more payday loans. I have recently gotten another job so that I would have money to live on, and I start that position on Monday. But if I don't have to be under this kind of pressure, I would be most grateful.
Any help and advice you can give will be appreciated. Also, any questions you have, please feel free to ask, as I am watching this post with bated breath!:confused:


All of the lenders you have listed here are illegal in one way or another. You need to close down your bank account ASAP to stop them from debiting your account any further.

Since they are all illegal lenders, you need to repay nothing more than what you had originally borrowed. From what you say, you have already overpaid on quite a few accounts and you should demand a refund.

Also, (I tried to edit my post above, but I was unable to do so), I was mistaken about my contact from Sure Advance. They sent me an email and said they are willing to settle for $253, which is half of the original loan (400) plus half of one renewal fee (106). I have paid them a total of $318, and sent them an email stating that I would pay them $72. Should I accept their offer? Or should I stand my ground?

Soaplady, when I sent my ACH revocation emails, I used the format that you outlined in your signature line and altered it to fit my circumstances. That email said that it was revoking wage assignment as well, so I hope that will be sufficient. I am going to print out my emails to all of the companies, and give them to both my employer and Bank of America, even though my accounts with them have been closed. I was thinking of doing C&D letters as well, but I want them to contact me if they are interested in accepting my terms. I just don't want them calling my job. Can I do C&D letters asking them to contact only me?

Day three, and so far so good...but then again, no one has tried to make a withdrawal yet!

Ten of the eleven PDL companies have been contacted and notified of the ACH revocation and the wage assignment revocation. The only one I didn't notify was Archway. I have tried to find an email for them, but have been unable to do so. Does anyone have an email address for them?? Also, QXLOnline didn't have an email address, but they did have a "Submit a Question" box on their website, and I copied and pasted SoapLady's message there. Only two of the companies have responded - Sure Advance and First American. I responded with a lengthier letter that I found that included the statutes they were in violation of and I haven't heard anything from either of them (emails sent yesterday and today).

I will be giving wage assignment revocation notifications to my employer tomorrow. They are cutting me a paper check this week because I notified them that I had closed my bank account.

I just want to take a moment to thank everyone for your help. This is SUCH a wonderful forum!

Update:

Cash Direct Express agreed to my settlement terms. I will be sending them two monthly payments beginning September 17.

Received a telephone call from Archway today. I didn't have their email address, but they were unable to withdraw funds. I asked the gentleman for the email address, and he gave it to me. He then asked what I was sending, and I told him that he would see it when he got it. I told him to have a nice day, and he hung up. (I'm learning...I'm not trying to stay on the phone with these people). He called me RIGHT back, and said, "Well, I just want to let you know that if you don't resolve this matter, we will be taking this to the next step." So, I told him, "Sir, you must do what you have to do. However, I would like to inform you that you are operating illegally. I am a legal resident of the State of New Jersey, and I am bound ONLY by the laws of the State. You are unauthorized to do business here, and I have informed both my bank and my employer of those facts. I hope you have a wonderful day." And I hung up.

Haven't heard from anyone else...still waiting.

I too was in your situation and I am in NJ. I sent them all an email saying they were illegal and to stop taking money out of my account. Many settled for the principal, one who I had only made one interest payment, called me an said they would settle for 65.10, original loan was 650.00-I paid that immediately!!!.

Things will get better, just close your account and take a breather. Most of mine have settled for less or the ones that I had paid over the principal, said "you are paid in full". The ones that don't settle, ignore them, they go away.

So, I received a call today from Matthew at "Efinance Support." They said they were calling regarding my loan from Bottom Dollar Payday. I asked for their email address, and informed them I would be sending them an email. I sent them an extended version of the email that I originally sent to Bottom Dollar, informing them that I would pay the remaining balance due on the principal ($30).
About an hour later, I got an email from Sophia at "Efinance Support," regarding my loan from Everest Cash Advance. I responded to her email with my standard email, and received a response that stated that they can only make arrangements over the telephone. I responded to that email stating that I would only discuss the account in writing and that I had already outlined payment arrangements in my previous email. I received an email in response to that email stating that due to security reasons they needed to discuss the account on the phone.
Should I call? I want to get this resolved, but I also don't want to get into a screaming match. I think I am confident enough (after reading so many of the posts here) to be able to stand my ground. But I also think standing my ground would be staying off the phone, as I told them in my other emails.
What do you all suggest?
