can you be sued in NY?

Hello All,

Can you be sued if you took out a PDL and live in NY. Ive paid way more than i should have on a loan to Nationwide Cash. I just got a call from them - and so did my co- worker (and they gave them a lot of info - kind of embarassing :(.

Anyway this guy left me a voicemail at work saying that i have such a great payment history and they want to know whats going on. If i dont call back they are going to send it to Arbitration.

My only worry is - is can they sue me?

Payday loans are illegal in NY. Debts are civil, not criminal. They cannot do anyting to you. On this site, click on forums, then click on payday loan help, then click on sticky on how to deal with illegal lenders. Follow every step.

Payday lending is prohibited in NY that means your lender is illegal. So they can’t sue you. You owe nothing more than the principal. Close down your old bank account and open a new one. Ask them for the refund as you have overpaid them.
