Florida Payday Loan Help Request

Hello,
I just found the site and am starting to get a handle on these loans.
I live in Florida and they were ALL obtained online.
They are all currently up to date and the payments are coming due again 10/5/.
I'm hoping to take action so they don't totally drain my account again next payday!
I read the advice on what to do to deal with unlicensed payday lenders.
Does anyone have knowledge of these lenders and if they are legal/licensed in Fl? Thanks!

ALL are illegal. Follow the steps in my signature for dealing with illegal lenders. You are owed a refund on the ones you have been debited more than the principal. You need to go into the branch and make a new account tomorrow... close this one and get a paper check for this pay period and change your direct deposit to your new account.

First I am guessing that the CashCall loan is actually a Western Sky loan being serviced by CashCall. With this being said they are all illegal. Make sure that you follow the instructions that Waffles gave. One thing I will say though is make sure you file complaints on all of them with the Florida Office of Financial Regulation at http://www.flofr.com/. If you file complaints with the FL attorney general they will just tell you to file with the FOFR. Don't let any of these lenders scare you none of them can do anything to you. Make sure that you dispute the CashCall listing on your credit report stating all FL laws regarding short term lending and usury rates.

The loan paperwork says:
WESTERN SKY CONSUMER LOAN AGREEMENT, lender: Western Sky Financial, LLC, This Loan Agreement is subject solely to the exclusive laws and jurisdiction of the Cheyenne River Sioux Tribe, Cheyenne River Indian Reservation.

Does that mean that it is a Western Sky loan being serviced by CashCall and it is illegal? I think I read that Cashcall is licensed in Florida, but maybe that does not matter in this instance?

Also, I have not cancelled my bank account or sent out ACH revocation yet as I was waiting on some legitimate check payments to clear my bank account.
Can I request that my bank do an ACH reversal for the recent payments on the illegal loans that I have already OVERpaid?

Since Western Sky originated the loan, it would be illegal. You are NOT bound by tribal law, regardless of what you signed. They know what they are doing, they know their paper is dirty .... enough Attorney General's offices have been after them due to massive amounts of complaints.

Do your ACH and wage assignment revocations NOW....then give copies to your bank and payroll departments. This will allow your checks to be deposited ...however IF they try putting a payment thru early, your butt is covered. When you go into the bank, talk to a branch manager only...not a teller or personal banker.

Be prepared for emails meant to confuse you....Western Sky will try to tell you that tribal law prevails...
