What should be my next step?

I got started on payday loans a while back. I found myself paying off loans to get new ones so I can also have enough to pay my bills. I found that I just could not do it anymore. I have done some research and have started following steps to fix the situation. I live in Illinois and am not sure I understand all the laws I have read. I have closed my account and have a list of the lenders. The problem I am having is what type of letter to send. I have had lenders even give money without my approval and that is when I decided enough is enough. I have a lender is is calling my working harassing and cursing at anybody that answers. What can I do? If I understand Illinois laws 2 payday loans is allowed and creditors are not to lend money to a person who already have two. I am seeking help.

Now for IL - here are the guidelines -
State Legal Status -
Lending of payday loan is considered legal in the State of Illinois. However Licensing Requirements:
Online lenders must be licensed in Illinois. -
Note: Transaction may be handled as an installment-payday loan. " Installment-Payday Loan: A medium-term loan where payments are made on each payday for six months."

Loan Specifications
Maximun Amount of Loan - Less than $1000 or 25% monthly gross income
Term of Loan - 13-45 days
Maximum Rate of Finance and Fees- $15.50 per $100
Finance Charge on $100 loan for a 14 day period - $15.50
APR for $100 loan for a 14 day period - 403%

Debt Limits
Maximum Number of outstanding loans permitted at a time - 2
Permissible number of Rollovers - None (Rollover cannot be done)
Cooling-off Period - 7 days after a period of 45 consecutive loan days
Repayment Plan - Yes

Limits of Collection
Collection Fees Amount - One NSF fee of $25 (Presentment limit is equal to 2)
Criminal Action - Prohibited

File your Complaint and get Information
Regulator - Illinois Division of Financial Institutions - Here is where you can check to see if they are licensed to lend in IL - http://www.idfpr.com/dfidefault.asp

Please, list out your lenders, how much originally borrowed and how much paid to date on each..

After we determine which are licensed and which are not then you will follow this link on how to deal with the ones that aren't - http://www.debtconsolidationcare.com/paydayloan/dealingwith-illegallenders.html - the ones that are you should still be able to call their corp offices and work out a extended payment plan - some may force you into collections to work out a payment plan you can live with.

250 from Hydra Fund in which I never signed for.
200 ABC Wages, 350 Geentrust, 600 Sign My Loan,
1000 with Castle Payday which is the second loan with them.
500 VIP Loan Shop, 1000 Silvercloud, 400 cashnet
200 Total Lending. Not sure what I have paid on some of these. Will have to get back with you on that.

Yes - please register with the forums if you have not - here is how - http://www.debtconsolidationcare.com/forum-tutorial/how-to-register.html -- You will want to have the $50 from Hydra Fund returned as unauthorized and have your account closed down and open a new one not linked to the old - it has obviously been compromised.. You can start looking these up to see if they are licensed to lend in IL - but from quickly looking at the list I doubt any are.. You will want to follow the steps in this link on how to deal with.. http://www.debtconsolidationcare.com/paydayloan/dealingwith-illegallenders.html - Knowing how much you have paid to date will help - on the ones not licensed to lend in IL - you are only morally obligated to repay principal minus what paid to date..

I have had to make sure I have all the lenders. I have never missed a payment until 6/14/13 when I had my account closed.
Castle Payday -$1000 paid $1025 - second loan
VIP Loan Shop-$500 paid$450- second loan
Hydra Fund II -$250 paid $150
Sign My Loan -$600 paid $302
Great Plains -$1100 paid $219.76 -3rd loan
Silver Cloud -$1000 paid $175 -3rd loan
Total Lending -$200 paid $60
Cash Net USA -$400 paid 0
Cloud 9 -$500 paid 0
Abc Wages -$200 paid 0
Green Trust -$350 paid 0
Namakan -$200 paid 0
There was a couple of these places that put the money in my account just because they had my info. A few of these places have started to call and harass my work.

On the ones that you have had more than one loan with - total borrowed and total paid on all loans? the ones that put money in your account with authorization - you should just return the money - I would secure my account right away - it has been compromised when they put in unauthorized money.. have them open a new account not linked in any way to the old.. You will want to follow all of the steps in the link I sent you before on how to deal with - here it is again. http://www.debtconsolidationcare.com/paydayloan/dealingwith-illegallenders.html - You are morally obligated only to pay back principal borrowed minus any paid to date.. on your terms.. tell your work you have been a victim of fraud and you are in the process of dealing with - you may get some calls.

As far as I can tell I think that Cash Net USA is the only lender that is licensed in this state.

I believe you are right on this - and the ones that you had more than one loan - how much have you borrowed in total on all loans? Then how much have you paid to date on all loans? we will subtract the two to see if you have over paid or owe anything at all - I am guessing way over paid.. we will want to do on all 4 with multiple loans with same.. Castle payday easy one - you owe nothing - but we will still want to figure out what amount you should be demanding as a refund...

Is there anything that I should do with the payday lenders that I have already paid off. There were two of them I paid an ungodly amount too. Then never used them again. This was a few months ago. Or should I just be happy I don't have to mess with them anymore.

It is up to you what you want to do.....majority of the lenders will not issue refunds especially if they are tribal or offshore. If you want to demand a refund, there is no harm in you trying.....again, remember you may or may not get refunds. Me personally, I would be happy that I am finished with them and move on.

I feel the same as you guys! I am just ready to get the whole situation over with. I did get my first reply back from the letters I sent. They want to settle for almost the whole amount and said it is now being sent to collections. I have had a couple loans with them and took advice and sent them a request for refund after adding all the loans principles and overpayments. I did research and let them know that they are not licensed in this state so the contract is not valid. Any help?

You will receive this type of BS. Just stick to your guns and demand the refund. Only answer them via email. If sent to collections, send the CA a cease and desist via CMRRR.

I have sent out a request letter to 2 different lenders one you know is not cooperating. This is the one that was discussed above. I have recieved a response for the other one who is sending out my refund. I am so gla things are starting to get better.

on Great Plains -did you not say you have had 3 loans - what is the total borrowed on all three together and total paid to date on all three combined.. I am guessing they probably owe you not the other way around.. I would be demanding that they take the total amount paid over the last three loans..

I have explains this to then twice. All three loans together were $2700. The amount I have paid is $4111.51. So they owe me $1411.51. The letter above is why they sent back to me about their tribal laws.

Just keep sticking to your guns - that you have already paid - you may have to resend a letter again to the effect of above.. tell them you are willing to forgo the refund, (that you will never get) in lieu of a PIF on the account..

There is a man named Marshel Taylor from State First who has called my mom, brother, place of employment, and my cell phone leaving a message that I am being charged with fraud. This is over one of these payday loans. I donor know which one. He said this is a notification of me being served. Here is the kicker it is in a state I used to live in a few years ago. Not the state where I live in now which is not when I took the loan out. Any ideas!

They are a scam - you can not be charged with criminal charges. They don't call before they serve and if they were legit they would know that.. I would try to get an address to send them a Cease and Desist letter. being that they are illegal who knows if they will follow one, I would start filing complaints with the FTC and let your family and employer know you have been victim of fraud.

how many charcters is the case number?i guarantee it's too many as being in il myself they are a scam.you can file FTC complaints using just the name national,and the number you hav.go to www.ftc.gov.other than that follow helpinaz's advice.

Why would they say they are trying to charge me in my hometown in a different state where I have not lived for 2 years. That is not even where I lived when the loan was taken out. He said there are 3 charges against me. That I am going to have to appear there through the curcuit court. They even called a family member I have seen or talked to for 20 years.

Are you talking to someone at the store level or are you talking to someone at the corp number? You want to talk to the corp office, they are the ones that can offer you a payment plan..

I have received a voicemail this morning stating that my county's judicial court has been notified and a summons was to be delivered tomorrow at my home or place of employment after 2: 00. I called the number they left and they said it was for a place called CGM or CMG I could not really understand her. She was talking so fast. She said if no arrangements were made that I would be going to jail for fraudulent charges. What should I do? I was told that what hPpened was they had put 250 in my account because they got info from associates and now want around 700 or summons to court in front of the judge. I called the sheriffs station who said they had nothing under my name

no place can have you arrested for owing a debt especially an illegal pdl which CMG is.report them and ignore future calls.they are using scare tactics because they have legal recourse.again report and ignore.first to the police.then to ms madigan the IL AG.just know they can do squat,but will threaten everything.

This place has called my family and left the same messages. Bank fraud. That if I do not get a hold of them a summons will be delivered for the williamson county judicial court. This is the county I live in. So I have got calls all day.

have evryone called file police reports.if they could do anything they threaten over the phone they would do it,and not violate the FDCPA by calling others and blowing up your phone.report asap,and know they can't do spit.

To put your mind at ease, see if your County Court system has a web site where you can check to see if any cases are pending against you. My guess is that nothing will be there--Just one more way to see that these people are ful of it.
