Please Read This Letter from PDL Collector

I just got the email/letter pasted below from a PDL collector. I don't know anything about this payday loan company. I am in Arkansas and due to interest charged on these loans, I have been told by the Attorney General's office that these loans are considered illegal.

My question is to the members who are experienced in these matters, does this letter viloate any of the FDCA laws/rules?? Would appreciate any input anyone has.

Let me introduce myself. I am Senior Affidavit Processor Dana Williams from State Investigation Department. As we were trying to reach you since a couple of days regarding a very serious matter about a lawsuit filed on your name stating that you are doing some fraud and criminal activities.

I am really very sorry to say you that you are going to be legally prosecuted in the Court House within a days. Your SSN is put on hold by US Government, so before something goes wrong, I thought I shall call you and notify you about this matter, but as I was not able to reach you, I am sending you an Email. So please take a piece of paper and write down your case file SF49390 and second thing since it’s a legal matter you will be needed my help, so please write down my callback number is 315-507-8391 Ext 2013.


For the records your personal information including your Date of Birth, your SSN #, you DL #, your Bank Account number etc, is listed on the case file, but cannot disclosed to you until you reply me on this.



The Factual Basis for the complaints are as follows:-

1) You have ascertained an income advancement from US Cash Advance with your Bank Account Information as collateral for said advancement.
2) You also agreed to return the funds from the aforementioned income advancement as per contract.
3) As of today’s date the funds have yet to be returned and the collateral has proven to be null, that is to say, of no value.

At present, US Cash Advance is seeking either of the following remedies:-
1) All funds be returned as per terms of initial contract.
2) You might be proceeded against to the fullest extent permissible by current Federal Banking Law.

So, as I investigate your profile, I found you as a genuine person so it is my duty to help you out but for that I need some right answers from your side. Also want to know your intention. So you want to resolve this issue out of court, or you want to go to the court house.? [COLOR=black][/COLOR]
This was a final notification Email to you if you want to resolve the issue by paying out of Court Restitution Amount than you can do that, or do you want to face legal action? You have to give me a flat answer without any excuse.

If you don???t owe this debt, then you can make a written request to the PDL collector via certified mail with a return receipt request for a debt validation letter. If they don???t reply, then forward them a C&D letter. After that, if they are still trying to contact with you, then file a complaint against them to the State Attorney General or FTC. Don???t share any personal information with them.

It is illegal to make false threats to the consumers. That much I know. Visit the county court office to find out if any case has really been filed against you. Check the court case number from the county court office. It is most likely a false threat. If you have not taken out any loan from US Cash Advance, then you can't possibly be sued for that.

Totally illegal letter...and not even written by someone who speaks english as their first language! If your state AG's office has told you the loan is illegal, relax! There are complaints about these people all over the web!

Send your AG's office a copy of this letter....although I suspect they have seen it before!

I get calls like that letter every couple of months. There is never any such department that they claim they are with. I immediately tell them that I know they are a scam and am going to report them and their phone number to the police and file charges against them. Then I hang up. Usually no call backs. If they have an accent, that to me is another sign that it is probably a scam. Anybody that is legit will send you verification in writing without question. Stay on your toes.

I tried calling the number in the letter to get a mailing address to send the DV letter and I get a recording that says "The magic jack customer you are calling is not available".

No real debt collector would have a magic jack and not have voice mail. I am going to try and get the address just so I can send the certified letter and have myself covered.

I wish I could cause them to be fined and maybe have to pay me as they have really made my life at work terrible. They call 5 to 6 times a day.

Has anyone ever been successful in getting money for the violiations?

Of course I will just be satisified with them leaving me alone.

I would not waste your time and money on the letter! It is clear that this is from an offshore collector due to the language. Think about it, it is hard to even read! They will not do anything to you other than call, as long as you do not answer your phone or respond to thier threats, they will go away.
