OMG - Lighthouse Recovery Associates
Date: Thu, 01/14/2010 - 09:08
On January 4, I received a call from Lighthouse Recovery Associates. I also sent them a debt validation letter which I e-mailed and mailed. On January 13, I received another call from them and I explained that I sent a debt validation letter to them previously. She asked that I fax the letter which I did. Today (January 14), I received another call. I explained that I had sent this letter three previous times and that all communication should be done in writing. I explained the above that I was willing to pay the off the principal amount of the loan, however, the stated the amount of the debt was $510.00, but they would settle for $350.00. When I said that I wanted to the debt validation letter, they stated that since I was refusing to pay, they were recommending to their client that they proceed with court action and that they were sending information to my employer.
My question is, what are my next steps and how freaked out should I be?
Thanks in advance for your assistance,
slm

Martin, they are clearly violating the FDCPA by continuing with their collection activities without replying to the validation letter. Hence, I don't think you need to panic.
Have they received the DV? Do you have the receipt of their receiving your letter? Just keep it handy for future references.
Practically, they are just using the scare tactics to coerce the money out of you. Neither the collection agency nor the lender has any legal leg to stand since they were operating illegally in your state.
Next time, tell them that you would be reporting them to state AG and also contemplating filing a lawsuit against them for violating FDCPA.

Thank you for your responses. I have filed a complaint with the Kentucky Attorney General, the FTC and the BBB today. I've been tracking all my activity and contact with them, and yes, I have confirmation that they received the letter. Panic sem-aborted. Thanks again.
