PA Girl with PayDay loans need advice
Date: Thu, 05/12/2011 - 13:44
I curretnly have 6 pdl's and I am in PA.
Simple Green Bor $ 1000.00 Paid 1203.72 Owe 601.00
My Cash Now Bor $ 750.00 Paid 525.33 Owe 741.38
Cash Jar Bor $ 675.00 Paid 818.50 Owe 562.50
Lokata Cash Bor $ 400.00 Paid 0.00 Owe 520.00
East Side Lenders Bor 300.00 Paid 90.00 Owe 390.00
500Fast Cash Bor 650.00 Paid 0.00 Owe 845.00
Now I got freaked out and just closed my account because I just couldn't catch up it they are all taking money out this pay. So now I have to send the letters of instruction to each loaner correct? I know that I have to pay them all back, but we just have to slow it down a notch. Some I have paid over my principle just in interest. I have been reading on these boards for days now, and I hope I took the correct road. Please...what would my next responsible step be? Tomorrow they all find out they are not getting paid. Thanks

You will need to send them letters/e-mails telling them that they are illegal in PA and that you will only repay what you borrowed. Make sure you revoke all ACH and wage attachment. You can find sample letters under "dealing with illegal payday lenders". If you've overpaid, then ask for a refund (doesn't hurt to ask; some have gotten refunds).

Okay the account is closed, and I am currently typing the letters. My bank was pretty good about closing the account so that was a relief. I am waiting for my phone to start ringing, which luckily it has not. I think now my worse fear is that they start calling my work. But hopefully with the "not legal in PA" letter, they won't. I will keep this post updated. And again, thanks for giving me the courage to go forward.

Also yesterday I sent an email to the Attorny General to see if I could get a copy of the actual payday law for PA, so I can use that in my letter and this is what I get back from them.
'Please be advised that this office is not permitted to render legal advice to

All I was asking was for them to point me in the correct direction..arrrghg.

Last quesion...for now. For the loaners that I do owe the money to, I should let them know in the "not legal in PA" letter that I am willing to work with them repaying my loan outside of my bank? Correct. I mean at least let them know that I do want to pay the original loan back. Or should I do this another way?
Thanks
when you send the letter with your state laws include the actual
when you send the letter with your state laws include the actual amount you owe.again their opinion will differ, but as you've seen.what you truly owe is way less than what they had you believing you owe.also make very sure your bank account is closed/secure as none of these places are to be trusted.once that is done make it clear you want to pay,but with money orders only.

I'm in PA and have been fighting the fight since last summer. I had six and I had paid the principal on 3, settled with one, and they've left me alone. A couple (Eastside for sure and another) have sold my "debt" and my personal information (I owe them each about $50.00 on the principal and they would never agree to accept a payment in the mail) over and over to the scam debt collectors who constantly call me at home and work and threaten to haul me to court. I always say fine, serve me, and hang up.
Keep copies of everything - go online and print out screen shots of your bank records showing the deposits and subsequent debits for payments. Keep copies of the initial agreements and any letters you send.
Make contact with people from the AG's office here in PA by filing complaints against the PD loan companies. Also contact the PA Dept of Banking. They won't give you any advice, but they can inform you of the laws.
You'll be in for a long battle and will get phone calls, but you'll come out okay in the end. Clearly you're not alone if you've been reading this forum! Good luck!

I'm in PA as well and started my battle early April with around 7 PDL's as well - East Side, Alpine Direct, Cash Jar, Magnum Cash Advance, Pack Management/B&L, US Fast Cash and Loan Shop Online.
After having my bank close my account and revoking all ACH authorizations, I switched to a new account and then got a prepaid debit card to pay my bills and PDLs from.
Then I went through all my bank statements online and then printed then and figured out I had overpaid CashJar, Magnum Cash Advance and US Fast Cash. Magnum sent me a PIF and haven't heard from Cash Jar.
After almost a month, I received an email from US Fast Cash (the audacity!) with their usual 'pay before it's too late' crap. Mind you, I stupidly overpaid these scum bags by $670! and they have the audacity to send me this email...ugh

I worked out payment plans with East Side and Pack. East Side basically just accepted what I came up with but Pack wanted it in 3 or 4 payments - which was still manageable for me. I sent them an email based on the template on this forum:
"To Whom it may concern,
I have yet to receive the requested mailing address from you, to which I may submit the balance ($210) of my principal amount $300 on 3/35/2011 in installment payments via prepaid debit card or via USPS with money orders only.

You have already received $90 on 8 April 2011 from my bank account towards payment of this loan.

I would like to submit payment on the following schedule;-

Apr 22 2011 - $40 - remaining balance $170
May 6 2011 - $40 - remaining balance $130
May 20 2011 - $40 - remaining balance $90
Jun 3 2011 - $45 - remaining balance $45
Jun 17 2011 - $45 - account PAID in FULL

I am willing to pay the principle amount of the loan only, however, no address or no agreement means NO payments, this is not negotiable.
I am still aware of the FACT that the loan you issued to me, is NOT legal or binding in my state. In the state of Pennsylvania , payday lending is not authorized.

As stated in my previous correspondence dated April 11, 2011, you may no longer contact my place of employment, or my references. I have revoked your right to debit my checking account. Please be aware that I have already provided a copy of this revocation to the branch manager at my bank. Any further attempts will be rejected by my financial institution.

If the above demands are not met I will have no other option than to file a formal complaint with the Pennsylvania Attorney General, the Federal Trade Commission and the Better Business Bureau.
I expect a response no later than Thursday April 21st, 2011 or I will have no choice but to file the complaints. Please be aware that I have sent this correspondence via email and have kept a copy for my records in the event that formal action needs to be taken.

I have received only a handful of calls at work, but they never leave a message.
Now, my cell phone is a different story. I started getting calls every hour from several different random numbers. They NEVER left any messages which confirms for me the fact that I'm dealing with illegal lenders. So after about two weeks of having my phone on silent but ringing every 30 minutes...I adjusted the settings on my cell phone to have those numbers go directly to voicemail (thank goodness for my G1). Which gave me a new founded sense of peace. And I do believe that some cell phone providers may be able to block some numbers at your request.
Hang tight, and go strong. I felt such a sense of relief and freedom once I began this process and was able to have ALL of my paycheck to myself and start back meeting my more important financial obligations. Experience was an excellent teacher as always, and needless to say I won't ever take out another payday loan.
Best of luck to you.

Your comments are well appreciated. So far Cash Jar and contacted me and said as of now my account is considered closed. Which I consider great, even though they did owe me. I am just happy to be done with one. Lakota Cash got back to me via email on Friday saying they were willing to work on payments (of course they inserted my signed documents as did Cash Jar). My Cash Now bounced back, and I emailed them at that same email address many times. So I got their physical address off of something they had sent me previously and am mailing it certified to them today. I am really having problems finding the PA laws on payday loans "verbatim". The A/G's office didn't want to touch it unless it was a complaint, and until I see it in writing I don't know how to word my complaint. Needless to say I am still waiting on 500FastCash, Eastside Lenders and Plain Green. I am slowly starting to breathe easier. I dread the part of them possibly contacting my employer. You know, who wants your boss to know that you made some bad choices. Anyway will check back in soon.

I sent you a PM with information about the law from the PA website along with the link.
