I have been reading this forum for 2 days until I've had a migraine but a "well worth migraine" may I add.

I have several ( to say the least) PDL's as well. I live in SC and was reading the sticky about them. It only lists one on the list and I dont have that one. So is there another place I need to look to see the legality of them?

Off the top of my head I know we have Cashcall, Mobiloans, Hydra, Vandelier, USWebcash, National Payday Loans

Ok here's my list that I've compiled. Doing this more so for myself so i can have somewhere to keep it updated. I've read on several sites that Pay Day One is the only legally licensed one we have in our state and I dont have one with them.

Western Sky/ Cashcall was $2500 paid $1111.50
Cashwell was $800 paid $651.60
vandelier was $300 paid $790 (ouch!)
hydra fund was $300 paid $750 (ouch!)
US Fast Cash was $500 paid $450
US Webcash was $600 paid $260.50
Mobiloan was $700 paid $140 (not sure this is considered a PDL)

I'm suppose to be going tomorrow to close my bank account which really has nothing to do with this but I'm sure will benefit somewhere. Someone has gotten ahold of our bank info and was creating checks here and there and I'm tired of stopping them.

In reply to Ksmith3, on the list of loans you provided, you show the amounts and all. Well, if you ever had loans with them in the past, and overpaid then, you can deduct that from what you may owe in principal on the current ones as you're entitled to. I do not know if you ever used PDL's before but if you did and used these sames at all, then just find records of what amounts you paid for that particular loan and I'm sure you'll see you overpaid in some. Good luck!

If I have this: [FONT=TTE593A008t00][SIZE=1][FONT=TTE593A008t00][SIZE=1]
[LEFT]Genesis Financial & Payment Systems South

USA Web Cash

Does this mean they ARE licensed in SC and if that's the case, it's legal and I still pay as promised? What about the excessive finance fee, does that rule then apply which for our state is $15/$100? I borrowed $600 and have paid $260.50 but my payments are $52.10 for 40 payments which will be $2084

OK here's my update so I can keep up with what I've done lol

Western Sky/ Cashcall was $2500 paid $1111.50
Cashwell was $800 paid $651.60 appears to be legal?
Vandelier was $300 paid $790 (ouch!) Letter Sent 10/6
Hydra fund was $300 paid $750 (ouch!) Letter Sent 10/6
US Fast Cash was $500 paid $450 Letter Sent 10/6
US Webcash was $600 paid $260.50 Letter Sent 10/6
Mobiloan was $700 paid $140 Letter Sent 10/8
One Click Cash $300 Letter Sent 10/8
National Payday loan was $300 paid $114 (no account #)
United Cash Loan $300 Letter Sent 10/8

Went on NPDL site and it asks for a pin number with ss# to sign in and I dont have a pin number. I've never been on that site, I must have got involved with it through a 3rd party of some kind. I dont have an account number though. I did receive a reminder email last week of the first payment that was debited last week so I could email that but without an account number, dont know how they would link it.

Then that will leave the fight with Cash call. ugh I haven't started there yet. I dont think it would be a bad idea if there were a totally devoted thread for them for all of us to share our stories etc.

I did close my bank account friday and opened a new one. In each letter referenced above I also included the ACH revocation.

Oh and I say all of this in a shameful way with my head bowed down :(

Wow mobiloans seems to cooperate pretty easily. Here's the email response from them although I haven't taken the time to interpret their tribal reasonings.

Your correspondence has been directed to me for review and I thank you for the opportunity to assist you at this time in connection with your Mobiloans Line of Credit Account (“Account”).

We understand that all situations are different and would like to offer you the opportunity to pay the remaining principal due on your Account in the amount of $560.00. We propose the following payment plan to coincide with your pay periods as indicated on your Mobiloans application:

    11/30/2012 - $112.00
    12/30/2012 - $112.00
    01/30/2013 - $112.00
    02/28/2013 - $112.00
    03/30/2013 - $112.00

To answer your questions regarding the legality of this loan, your Account Agreement indicates that your Account is governed by the laws of the Tunica-Biloxi Tribe of Louisiana, (the “Tribe”) a sovereign nation recognized by the United States of America. As such, the laws of the Tribe permit Mobiloans to offer the Account in accordance with Tribal law.

In addition, MobiLoans, LLC (“Mobiloans”) is organized under the laws of the Tribe, is owned and operated by the Tribe, and operates exclusively on land owned by the Tribe. As such, Mobiloans is an “arm of the Tribe,” and entitled to sovereign immunity and therefore not subject to any state laws.

In any event, pursuant to your request, we have removed your contact numbers from our system and we will make no further ACH debits from your account.

Please reply to this email if you accept this offer to settle your Account and we can set up a payment plan.

    Thank You,

    Mobiloans Account Service Team
