I am in MA



Using the letter template, I indicate that I know that they are illegal in my state.
I requested no calls to my home or business or work telephone and to communicate only in writing and cited the MA law.
I requested a physical address for correspondence.
Provided the amount of the original loan, the amount paid in fees and demanded a full refund of the difference between the principal amount and fees paid.
I indicated that I had been in touch with both the MA Attorney General, the MA Division of Banking and would file complaints with them and the FTC.
I will also seek validation of the debt, so I can deal with the CRA issues.

I have searched for physical addresses and will send CRR letters, but will also send confirmed to email addresses.

Does this make sense ? Am I missing something? My bank was very cooperative in closing my 19 year account and opening another, and even offered to help by making calls. I may have to take them up on that. Also, I need to do all of this before I am 30 days delinquent on the fees.

Here is a listing of the PDL companies. They are all on the cease and desist list for MA, some under another name, so you have to look closely.

I am more than willing to pay the principal amounts. Most of them, I have paid in excess of that. The one that I have not, I want to pay them on a moderate payment plan of the principal. I had to keep paying them and then reloaning in order to keep from totally drowning. Some of them I understand from PDL Consolidation are the same, and one is off shore.

I don't know abt MA laws but if PDLs are illegal in your state you are in a good position. So if PDLs are illegal in MA then:
- Paydaymax and discountadvances are both Credit Protection Depot and these are the guys you need to talk to. I had a paydaymax loan which I overpaid and I got a PIF from them in 2 days after faxing and e-mailing them.
- Zip19 is also highly illegal and I personally didnt have any problems with them. Again, maybe because I overpaid the loan. Actually I had that loan so many times that I told them to apply the extra fees to the principle of my last loan.
-Ameriloan acts tough but its not impossible to deal with them
Please let us know what happens with Cash Advance Net...I have a loan with them too

For your reply. All of these companies are illegal in MA and the cease and desist list. Interesting about Zip19. I did three reloans on $1040. So I doubt if I have any overrage. You mean the parent company is Credit Protection Depot ? When you say you got a PIF from them you mean they just rolled over ? Did they report to the CRA ?

Looks like you overpaid all your PDLsexcept for Zip19. However, you say that for 3 x 1040= 3120 you paid 3900$ this means you already have 780$ which you can apply to your current balance. You say your account is closed so you have nothing to worry about. They might give you the option to sent them whatever you owe by western union.
I don't know what you mean by INF fees. But when I dealt with Credit Protection Depot all I did was fax them and e-mail them. And after that I even had the nerve to call and ask what's my account status. They closed my account the same day. My boyfriend had to fax and e-mail and call for 3-4 days but in the end they closed his account too. Never heard from them. Credit Protection Depot is the company that collects for both PaydayMax and Discount Advances. You are also entitled to a refund but I was too happy to get the account closed and didn't push them for a refund.

Thanks wildk. With PayDayMax and Discount Advances, what did you say to them and why did you fax and email? I don't want to go overboard and inflame them. Yes, re: Zip- will send them the balance.
The first thing I have to do is get my bank to give me copies of my statements from my old account. I no longer have access to them. I want to be sure that I am calculating correctly. Thanks so much for your help and the email address. I was able to get onto the sites and look at my agreements for the dates and original amount to ensure I know what I am talking about.

I faxed and e-mail paydaymax and discountadvances because in my experience this was a faster way to reach them compared to actually sending the letters via regular mail.
So I adapted to my situation the template letter which you can find everywhere on this website and faxed it every day until I got a response from the PDLs.
I know that everybody else here sent their letter via mail but in my case I discovered everything worked out a lot faster. I even got PIFs the same day after me faxing the CD letter and a refund the next day. I was very lucky.

Thanks wildk and Shazzers. I have sent all the letters via email with a receive and read request. I also added my bank manager and the consumer complaint rep at the Division of Banks. I hope I did this right.

In my letter, I cited the Comm of MA regulations re: collections, payday loans and laws which govern under $6k loans fees and interest rates. I also included the void ACH and wage garnishment passage.
Zip19 and PayDay Island are located offshore.

Try sending them with web mail, it doesn't surprise me that it was undelivered, illegal lenders deactivate their email addresses.

Thank you Shazzers. I did try sending it to a number of email addresses and no matter it bounces back.

I got this email from them, when they discovered my closed account and before I sent my email to PayDayMax and Discount Advances. The address from which this came, also bounced back. Both of these companies have c&d orders from the Division of Banking in my state. AND, all pdl are illegal.

All of the addresses for Credit Protection Depot, Discount Advances and PayDayMax have bounced back. Should I now call to get a physical address ? Should I just file a complaint with the Attorney General. How in heck can I invoke my rights, if I can't send them the letter ? Fax. Dang, I don't have a fax service from home. Any suggestions?

you can check the BBB for physical addresses, they usally have them.
if you need to fax them do not use your company's fax machine, go to staples or a store like that to fax them (it's like a quater a page, not expensive at all).
file your reports asap. you are on the right track :)

how is this all going? I am just starting to dealing with them now, tomorrow they will not be able to get the money out of my account, it has been closed.

I have had them for a long long time. I faxed them all letters and emailed them all. Also notified them they can't do wage assignment.

Zip I owe $1400 plus fees is 1680, but I have borrowed from them so many times.

MA law states:

Chapter 140, Section 96, an entity engaging in small loans for amounts of $6,000 or less cannot charge an annual percentage rate of more than 23 percent or fees greater than $20.

so I told them all the fees should be applied to my principal balance, I will let u know what happens.

Will keep you posted. Zip19 stopped calling. I am getting some calls on both cell and fax that are anonymous and I suspect it may be one of the pdl.

I will keep you posted. BTW, the Division of Banking requires that you download and mail their complaint form. I am doing that today. I am kind of suffocating from the fear. Haven't checked my email yet. Will do later.

Hi,

good keep me posted. I have not heard nothing today yet, I dont like the employer thing and wage assignment. I did all I can sent my letters to them to revoke and also told my employer payroll and my boss, which really stinks.

Zip seems like it would be the hardest one to deal with, I owe the most, but we will see I guess. I want to work with them and pay them off but at easier terms.

Also I did talk to a payday consolidation company and they basically charge $200 fee to sign up and $90 a month(30 each PDL loan) I think is crazy. Since the PDL's can still call me till they have enough money to pay them. So I figure my best best is to work with the PDL's and get these gone sooner or later.

Hope all goes well for both of us, this is a painful process, but my other bills just getting farther and farther behind. So I had to put a stop to it.

The nightmare begins. I stood my ground, I borrowed $400 from paydaymax and have paid about $775 in fees, I told them to apply that according to MA laws, which state they can not charge more than 23%, so minus the fees, you owe me a refund. They said the manager is reviewing my faxes and will get back to me. I said ok, thanks. I have been sending Faxes daily to them and Zip19.

Someone called my work today, I said hi this is Tim and they said sorry wrong number. Bull, I think it was Zip.

I said by phone. Will you be sending me a letter telling me this is PIF. She said no, we will no longer be communicating with you.

Just received a call from somebody, wouldnt say, but from out of the country for sure. Stating we are recording this in the Courts of MA, we sent you legal documents for fraud. I am like ok for one you are charging interest way and above what is legal in MA. I have already paid back above and beyond what I should. He said they send me court papers and will see me in court. I am like here is my lawyers number, oh no sir you need to call your lawyer and have them call us.

I dont think so, I stated the laws here and told them to have a good day
