LETTERS TO Illegal PDL's

Here are the 3 letters I am sending to the 3 illegal PDL's. Please advise me if I need to make any changes. Thank you!

Dear Lender:

It has come to my attention that payday lenders must be licensed by the state of California in order to offer loans to its residents. Since your company has no license in my state, the loan contract I have with you is not valid. I have made recurrent payments on my loan every other week since December on this current loan, so I no longer owe you any money and in fact should be due a refund. However in the interest of fairness. I am willing to accept a paid in full on my current loan. You will not be getting any more money from me from my checking account.

I am also revoking authorization for ACH withdrawals and any wage assignment I may have signed. I have given a copy of these revocations to both my bank and my employer. Any future attempts to collect funds in this manner will be blocked.


2nd letter

Dear Lender:
Re: Advance Me Today

It has come to my attention that payday lenders must be licensed by the state of California in order to offer loans to its residents. Since your company has no license in my state, the loan contract I have with you is not valid. To date, I received a deposit of $200 and have had 4 bi-weekly withdrawals of $60 debited from my account and $60 along with $50 towards the principle debited at Midnight June 14th. This results in an overpayment of $100.

At this time I am requesting a return email acknowledging that my loan has been paid in full. Also, I would like a refund of the $100 overpayment. A refund check of $100 should be mailed to me at the address you have on file.

I am also revoking authorization for ACH withdrawals and any wage assignment I may have signed. I have given a copy of these revocations to both my bank and my employer. Any future attempts to collect funds in this manner will be blocked.
Please respond to this email with acknowledgment that my account has been satisfied in full. Details of when I can expect the refund check, as discussed above, should also be included in the email.


3rd letter

Dear Lender:
Re: PayDayMax

It has come to my attention that payday lenders must be licensed by the state of California in order to offer loans to its residents. Since your company has no license in my state, the loan contract I have with you is not valid. As I have taken out several loans with your company and paid back all of them on time. And have already made 2 renewal payments on this current loan. I no longer owe you any money and in fact should be due a refund. However in the interest of fairness. I am willing to accept a paid in full on my current loan. You will not be getting any more money from me from my checking account.

I am also revoking authorization for ACH withdrawals and any wage assignment I may have signed. I have given a copy of these revocations to both my bank and my employer. Any future attempts to collect funds in this manner will be blocked.
Please mark my account paid in full.

Please do not waste your time telling me that I am subject to Costa Rican Law....I am not and you know it. I have overpaid this account. Please do not start telling me I am subject to the laws of St Vincent....you know as well as I do that the only laws that apply to me are the laws of California.

The only thing I would add is a statement about all communications going forward be in writing via US mail or Email only, that they are not allowed to contact you or any of your reference by phone at home, cell or work..

Make sure your secure your bank account, the best way is to shut down the old and open a new one not linked in any way to the old.. Keep us posted..

Well the letters are sent the bank account secure. I am feeling very liberated at the moment and really nervous. Thank you all so much for your help, I wish I could give you guys all hugs!

Hi There,

First, I'll apologize for coming up anonymous but I can't seem to log in and my password isn't being emailed to me.

Anyway, I wanted to say how thankful I am for these forums! A month ago, I was in serious trouble with payday loans...over $4000 in payday loan debt. I was desperately seeking a way to get out of it and considered going through a service to consolidate. I came upon this forum and realized that most of the loans I had were from illegal lenders and I had way overpaid most of them. SO, I got to work and started emailing them the letter I found on this forum, Long story short...I have received responses from most letting me know that my loans are PIF and a couple didn't respond but show my account as PIF on their website. As of this morning, I have paid all but one payday loan in full and hope to pay that one within the next 2 weeks. Here are the loans I had and their status:

ILLEGALS
Mobiloans ( 2 loans totaling $1500) - PIF
Advantage Cash Services ($400) - PIF
CashYes ($350) - PIF

LEGALS
ACE Cash Express (2 loans - $300 each) - Sent them email revoking ACH and asking for payment arrangements and now website is inviting me to reapply. Do you think they wrote it off?
CashNet USA - PIF through EPP Plan
SpeedyCash.com - Paid off
CashMax - storefront - Paid off
CA Check Cashing - will pay off next payday!

Great news!! And as for ACE - I wouldn't think they would write off - I would call their corp office and find out the status, they will send to collections.
