Tribal /offshore Lenders Follow-up Question

So I was dumb enough to get involved with several lenders including Ameriloan. MobiLoans, Cash Jar, Plain Green, and Great Plains.

This was before I was unaware that all online lending is prohibited in Iowa and unaware of the remedies described here.

In most instances I have already paid the principal (and then some).
Do the remedies/instructions here generally work with tribal/Offshore Lenders? Have they been responsive to others?

Great Plains and Plain Green have been the worst to deal with. The others were quick to agree to just the principal but I guess they would since they know they made illegal loans.

Since I've already paid more than the principal with some I'm going to try the approach of asking them to mark the account paid and to cease all activities. I've already changed bank accounts and revoked ACH authorization.

Any other suggestions/experiences that may be helpful?

All of you guys closed your bank account before sending them the letters? If not, will they really try and clean out your bank account using ACH?

You need to close the account before you send the ACH revocation letter/email. All banks operate differently but mine allowed me to open a new account and they took a list of any authorized transactions/checks pertaining to the old account and they blocked everything else.
If you don't close the account or make arrangements with your bank to block the ACH activity they'll do whatever they can g to get money out of your account.
My bank was probably an exception on how they operate so the safest bet is to close the account. Ask to speak with a personal banker or manager.....Not just a customer service rep.

You need to close the account before you send the ACH revocation letter/email.

That is not a very hot idea simply because if you close down the account before revoking ACH, any requests sent through in the mean time will go through and be returned as NSF thereby racking up $30 a pop. Enough of those and your bank will reopen the account that you closed and you will be stuck with the NSF charges plus the OD balance.

Don't let any one tell you that you were stupid - we have all been there and understand you did what you thought you needed to to pay your bills.. Plain Green should be fairly easy if you use the template letter in the link I sent you above - tell them that in place of a PIF on your account you will forget that they owe you a refund of $577.00.. Great Plains may tell you that they will not apply the two loans together, keep pressing them eventually they will give in for principal only on the remaining balance - so both loans were for $400 .. I would tell them exactly what you said - you are willing to pay the remaining $81.00 and that is all..

I would email right from their customer service link on their site - you get a response right away telling that they got it that way...

I should have been more clear about that. I was referring to having the ACH revocations to the bank so that's already on record when you close the account. Sorry about that.

You need to do at the same time basically. Have your letters ready to go, take them into the bank and shut the account down and then mail or send immediately!! Emailing is the best if you can they get right away and normally you get at least a generic email back saying they got it if you sent it through their customer service lines.

Original loan from Plain Green was for $1000. I had paid back a total of $1577 before I started things in motion to keep them from getting any more $$ from me.

I 'm actually on my second loan with Great Plains as I fully paid ($719) the first $400 loan. I took out another loan in Januray which I haven't paid anything on. I'm trying the angloe of telling them to apply the illegal fees from the first loan to the second loan and I've offered to pay the remaining $80 to satisfy the principal.
I've adapted the letter here and emailed them and I'm still thinking about certified mail even though I know the addresses they use are basically just a drop.
I have similar loans with MobiLoans, Ameriloan, CashJar, and a couple others that are all illegal.
With the exeception od Plain Green, Great Plains, and MobiLoans they've been mostly responsive and have offered to settle for principal (without accounting for the fees I've paid) I guess they would since they know their loans aren't legal. I'm pressing the others to apply everything I've paid to the principal and provide me with a Paid in Full status.
Go ahead and call me stupid for creating this mess. :-) I'm way, way old enough to know better.
I am in the process of reporting them all to the SAG.

So far, mostly "so good" dealing with these companies . I'm posting my numbers since I didn't earlier.

1. Plain Green Borrowed $1000 Paid $1577. PIF Received

2. Great Plains Borrowed $400 Paid "0" and they won't budge on applying $320 overpayment on previous loan. For now I'm probably going to pay the $400 principal on the second loan.

3. MobiLoans Borrowed a total of $800 and have paid $759. They will settle for the balance of the principal which I will pay.

4. CashJar Borrowed $600 Paid $1250 PIF Received

5. 500FashCash Borrowed $500 Paid $1248 No response yet

6. Ameriloan Borrowed $550 Paid $1420 No response yet

7. MyCashNow Borrowed $1380 Paid $997 Agreed to balance of principal

I saved the worst for last, in terms of dollar amount.
8. Magnum Cash Advance- In 2012 I borrowed a total of $6884 and paid back a whopping $14065 before I stopped the madness. PIF received

The above is how bad it can get when you';re desperate and start the never-ending cycle of PDL/line of credit/installment loans. I've been borrowing from Magnum for three years so you can see the amounts are staggering. All of the above is a prime example of what NOT to get yourself into.

In all cases of an overpayment I have requested refunds, but I'll never see anything I'm sure. Everyone that has supplied a PIF has of course included the usual BS about sovereignty, their laws trumping everything else , etc. that we all know isn't true.

Hopefully I hear from the last two soon.

while I haven't received any direct communications from them, My 500FastCash.com account now says: "Congratulations, your account is Paid in Full as of 2-23-2013."

The funny part is under that it says "Click here to borrow additional funds" Do they really think I'm that stupid?

Still haven't heard anything from AmeriLoan.

I never really checked to see how much I overpaid them but I may just to satisfy my curiousity. I've had multiple loans with them.

What soaploady said. The links in her post were very helpful to me as well as some other advice from reading other posts in this forum.
I was scared to talk with my bank as well but they were very helpful in allowing me to open a new account and only paying the "leftover" items that hadn't cleared yet.
Tribal/offshore/foreign payday/line of credit/cash advance lenders are all illegal. As the informaton says, you are only morally obligated to pay the original principal of what you borrowed. If fees/rollover have already exceeded what you have paid them, tell them how much you have paid and that you want a paid in full letter or email. If you haven't paid an amount equal to the principal yet then suggest a payment plan you are comfortable with to pay the rest of the principal and nothing more.

You'll find this explained pretty well in the links in the previous post.
Don't let them scare or you or try to intimidate you. They're basing all their threats on thinking you don't know the loans are illegal and they can't legally collect on them or enforce the contract.
I'm not too far into this myself yet but this forum has been a wealth of help.

Great News on 500 FastCash - Print and keep in a safe place.. And yes they are certainly hoping that you are willing to re-borrow - but what does that say about them since now you know that even if you did you only owe principal.. LOL

....Is going through bank statements and actually adding up everything I paid to these various scammers. I just finished going through stuff for 500FastCash. So far, with rollovers, etc, I had paid them over $1200 for the original $500. I almost afraid to finish adding things up......But I will.

That means that they have gotten your email.. I had the same thing.. you may have to resend an email to them - to get a response I would give a few more days. You can resend to the one your originally sent to.. should be like - support@plaingreenloans.com - I have some others for them if you need them let me know..

Guy from Iowa - Any advice you can offer would be tremendous. I am in a MESS of massive proportions. I have WAY too many payday loans - almost all online - and many of them are with tribal lenders (which I'm scared I can do nothing about). I am so busy working 2 jobs (a full-time AND part-time) and going to school that it has been difficult researching what I can do. Any Iowa specific advice you have would be helpful. I'm unable to get a loan from my credit union (way too much unsecure debt - even with a co-signer) to cover the cost of paying these loans off. So far I think the route I will have to take is to close my account, but I'm scared of the legal action, because I have to do this all as discretely as possible, because of the organization I work for and things I am affiliated with. If you can help, please, please, please let me know. Thanks so much.
