Basically, if you get one of these collection calls, it's best to start with a Validation letter, especially if they collector is not forthcoming with any basic details about the original loan?


They have to send you a Dunning letter first within five days of initial contact as per the FDCPA. So wait for that first. On that letter, there should be a mini-Miranda warning saying something as to the effect of you have 30 days to ask for validation. If something of the above doesn't happen, they already made a (or several) violation(s). After you get the Dunning, yes, send them a debt validation letter. Make sure to send it certified mail, return-receipt requested even though CMRRR is a bit expensive. You need proof you actually sent them the validation. My bet? They never send the Dunning and just try to harass you over the phone. Keep telling them you will only communicate by US Postal Mail and hang up. Don't let the phone intimidation get to you at all.
