Is PayDay Max legal in Mississippi?

I was harrassed by PayDay Max today. I had a loan with them and when I contacted them after I closed my account letting them know they they wre not licensed in my state and that I needed to work out a payment plan to repay the principal only, I never received a phone call back. Now I'm getting phone calls from PDM, except they are calling themselves Pay Day Management and not PayDay Max...what a coincidence. Pay Day Management is supposed to be the so-called collection agency for them. The guy said that I needed to pay the money back and that I needed to get a lawyer and he wishes me the best of luck. I know I owe the $300 but not a penny more. They are trying to get $600 from me. I want to pay the $300 but nothing else.

Do I need to send a C&D letter and another letter telling them not to contact me by phone, they are unlicensed in my state, and all that good stuff (I forgot the name of this letter)...they have me fired up.


The nature in which he told you he wished you the best of luck sounds like a threat, any legit company would not do that if they are familiar with the FDCPA. They aren't licensed to lend, as long as you have followed the steps in the sticky titled "How to deal with illegal lenders" you should be alright.
