They Got us...
Hi all...
My husband and I took out a loan from them... orig. amount $500 + $1100 in fees.... I sent them the letter that we were revoking the authorization to charge our account any further... below is the response we got...
"This is a Costa Rica company. Costa Rica and the United States are
both parties to the General Agreement on Trade in Services, a treaty
which specifically permits companies in one country to make consumer
loans to citizens of the other. Under the treaty, we are only
obligated to follow the federal laws of the United States. We are not
required to obtain state licenses and individual state laws do not
apply since the federal laws adopting this treaty supersede any
state's laws on the subject."
Does anyone know if theres truth to this? I looked up the GATS, but I dont' see anything in there stating that they don't have to abid by state laws.

My answer to that is just like the payday lenders that claim tribal sovereignty, I am a citizen of the United States and I am bound by the Federal Laws and the laws of my state. I do not live on your reservation ( as in my case) or in your case Costa Rica, and I am not bound by your laws. If they do not follow our laws then how can they legally pursue anything because it would have to go to court in the US. Just a bunch of BS to get you to pay. There is no such thing, they are required to be licensed to conduct business as a payday lender. File a complaint with the Federal Trade Commission and your state office of financial regulation regarding this and see how far that gets them. I guarantee you this is not the case. Check the Federal Laws when you call the FTC.

It's a bunch of BS. There are no federal laws regarding payday loans. Remind that that you are not bound by their laws and they aren't getting another penny from you.
