I got a payday loan in July of 09. I couldnt afford to pay it back. Now almost 2 years later i get a call from Monarch recovery saying im going to face federal charges for bank fraud and blah blah blah. I called check n go and the store is no longer open so i called a 1800 number and they said my account has been sold twice and they no longer have my account. I can make payments to them but they want the whole amount for im facing charges! Is this true? What do i need to do?

Did you actually write a check? As far as the fraud charges go, they have to prove that you wrote the check with the intent to not pay it back. It's difficult to prove intent. I would request a validation of debt from Monarch, I doubt they'll have it. In the mean time, start making payments to Check 'n Go. How much do you owe them? If you don't know, I would find out and just pay them what you can until it's paid off. Keep records of your payments and, once it's paid ask them for a paid in full letter.
