I have had past problems with PDLs, but has been over a year since I closed my bank account and settled with several companies. I was just at our local grocery store, and wrote a check, gave me them my drivers license, and they told me that they could not accept my check because I was on the NCN bad check list. I have written 100's of checks to this store in the past 20 years, and have never had a problem... They gave me an 1-800 # to call NCN, so I did immediately. They told me there were 2 checks from 2008 that were listed as NSF, one for $200 to National Payday, and $625 to MyPayDayLoan - and gave me 800 #s for both to call, as they could not do anything about it, until I talked to them. Can they do this and does anyone have any advice for me?

If there's a bad check report on you then they can refuse your check. I don't have all the information, but it seems strange to me that it would suddenly happen to you like this after so long. I would call the companies and find out why they suddenly reported your checks bad, and some proof that the checks were paid.

I am in North Dakota, and yes they were both Internet loans with no actual check involved.
I checked further into these, and one is from National Payday, and the other is from MyPaydayLoan. They have both been referred to Detex Agency, and they will not talk to me about them. I have paid them more than the principal and legal amount of interest, and they are still trying to charge me more. Any help would be appreciated!

I had a feeling that was what happened, I need to do a bit of research, but will get back to you as soon as I can.

When you file this complaint, make it as detailed as possible, explain these lenders are not even licensed to lend and you have MORE than paid them off, explain they have reported you falsely and how it has affected you. After you complete this complaint, send a copy of it to:

I sent a debt verification e-mail to Detex Agency, since they are now trying to collect both of these PDL amounts. I am asking for all documentation of these loans, including Original Loan Amount, Interest charged, Payments made(including dates), so-called NSF Check #s, and also any PREVIOUS loans taken from these 2 companies. I would like all of this information in writing within 30 days. If I do not hear back by then, I will then purise further with States Attorneym FTC, and BBB. Am I going about this correctly?

Keep records, you may need them. Honestly, I have never heard of any legit collection agency sending a letter of collection via email.

Here is the response I got from Detex....

[FONT=Arial][SIZE=3]Please find enclosed two attachments (.pdf) of both your contracts with MyPayDayLoan.com and NationalPayDayLoan.com. Please notice in your agreement with the contract that enforcement is by laws of Costa Rica. Any reporting, as you describe below (NSF list), would have been performed by your previous creditors, not by DETEX Agency, therefore, only the Creditor takes action to correct any reporting.

In order for you to receive both cash advances, you would have also agreed to a check electronic transfer agreement so your Creditors could not only deposit your cash advance, but you also agreed permission for them to withdrawal. This process, although electronic, is considered just as if you physically authorized a check draft. Our office can obtain this document in which you provide this authorization but this is moot since neither creditor will deposit nor attempt withdrawal.

Please understand, currently your accounts are not incurring additional interest or fees. DETEX can offer you an opportunity now to make payment arrangements that can halt all collection and offer you free payment processing to resolve both accounts. Once both accounts are resolved, the Creditors will then correct any reporting to agencies.

In the event you decide to continue your dispute instead of taking this opportunity to establish payment arrangements with our office, DETEX Agency will then return your accounts (within 30 days) to the Legal Department of each Creditor for their attention and your debt may be subject to additional fees and/or costs.

Do you have any more advice on what to do now?

Ohhhhhhhhhh, I get it now, how stupid do they think people are! Just respond back to them in this way:
Please note I am not a resident of Costa Rica, have never prescribed to be a resident of Costa Rica and have no Costa Rica presence, as such am not subject to the Costa Rica laws you detail.
