Struggling with National City and I am fed up!! Please what do I do?
Date: Tue, 08/18/2009 - 07:56
I am so angry. This is the second manager I have talked to. I mean, personally what business is it of the bank who my creditors are and what I owe them? He said they can garnish my account if they want. In the past month they have charged me again over 800 dollars in overdraft fees, because the stop pay I put on one of the PDL went through!! ANd they charged me 35 for the stop pay, then 35 a day after the overdraft charges were in place. I am trying to get myself straightened out and there is no way I can do that without a fresh start and getting a hold on my money.
I have no problem making arrangements with these pdl to pay them back, but why won't the bank close my account?
OK, so next question...I can open an account at my credit union today and switch my direct deposit there...what legal ramifications will I have for just leaving my account at national city? I mean, not closing it...since they won't close it? I have no checks out and will not have any out until I get this taken care of. When my next pay comes, with all of the overdrafts and pdl I will be in the negative again...if I can't do something....please advise...I am desperate!

Hi CardTara -
I have an account at National City and they have been nothing but wonderful with helping me over the past week. They reversed my debits from 08/07/09 and also but a hard debit block on my account - the manager I spoke to, as a matter of fact this morning, told me that nothing else will go thru. Where are you located at?

I am in Pittsburgh. They are switching to First Niagra bank here shortly and it looks like it will be worse! I went to my branch twice and no help. What did you do to get them to help you?? I really don't want to bank there anymore, but they refuse to close the account.

Yes, the other branch told me I have to go to my branch where I opened my account...even thought I told them what was going on, I can't get any help. At this point, I am scared, I don't know what to do. If I leave the account go at national city and open a new one, what will they do with the account at National City....

I think you should try another branch as well - I just went in and explained that I needed my account closed becasue these pdl's were taking money out of my account and I could not afford it. I explained to the manager that they are illeagal and even though I did make the mistake to borrow from them - they are underhanded and will continue to take money out of my account even after they are PIF.
Is your account overdrawn now?
Have you tried calling the 800 number and reporting the withdrawls as fraud?
It is not overdrawn at this time.... The fraud department said
It is not overdrawn at this time....
The fraud department said they would find a number and have to do a three way call to verify the information. In the case that I gave them access to my account, then surely they can not stop them as it is my fault. While I agree that it is my fault, I feel like the bank should not care how I handle my debts.
Tell them its identity theft and you have no idea how they got y

Haha...I tried that the second time, they said not to worry, they would get them on the phone with me and verify I.P addresses so they could trace it back to me if that was the case...and they would investigate it. This is what the bank told me. I talkes to my friend about it, she told me to open a new account somewhere else...that National City will only let your account go for so long and then collect on all of the fees you owe them. I am afraid at this point I have no choice.

cardtara - I just sent you a PM - but anyway - I am in MI - I'm not sure if your National City is the same as mine..is it a PNC bank? Let me know if so - I will go to my branch and speak to the manager regarding your issue - maybe she can give a direction for you to go in?
OK, I will check my PM...It is a PNC branch, but no transactions
OK, I will check my PM...It is a PNC branch, but no transactions can go through PNC. It will be First Niagra in a few weeks...where they will charge you for every debit card transaction you make...what a joke. I will check my PM
ok - I'm going to lunch now and will see what I can find out for
ok - I'm going to lunch now and will see what I can find out for both of you (cardtara and national city customer 2).
Where are you at national city customer 2?

I'm pissed that your financial institution will not abide by the law and revoke the ACH transactions, they are bound by federal law to follow through on Regulation E at the consumers request. Please read it below.
Regarding the EFTA and Universal Debit Agreements..
[samebox:28f8ab594a="Shazzers"]?? 907. Preauthorized transfers
(a) A preauthorized electronic fund transfer from a consumer's account may be authorized by the consumer only in writing, and a copy of such authorization shall be provided to the consumer when made. A consumer may stop payment of a preauthorized electronic fund transfer by notifying the financial institution orally or in writing at any time up to three business days preceding the scheduled date of such transfer. The financial institution may require written confirmation to be provided to it within fourteen days of an oral notification if, when the oral notification is made, the consumer is advised of such requirement and the address to which such confirmation should be sent.
(b) In the case of preauthorized transfers from a consumer's account to the same person which may vary in amount, the financial institution or designated payee shall, prior to each transfer, provide reasonable advance notice to the consumer, in accordance with regulations of the Board, of the amount to be transferred and the scheduled date of the transfer.
Regulation E
Section 205.10 Preauthorized transfers
Requires financial institutions to provide the consumer with some form of notice that electronic transfers that recur at substantially regular intervals, such as the direct deposit of salaries or benefits and the preauthorized payment of bills, occurred as scheduled.

I know Shazzers
It is crazy how some of these banks act toward their own customers. I for one can't wait to be rid of National City. I'm hoping Danni comes back with some knowledge from her branch manager that can help cardtara and myself.
If it were me, I would send a detailed letter the to CEO of Nati
If it were me, I would send a detailed letter the to CEO of National City. I'm willing to bet you could find an email or fax number to the corporate office by googling it. I did that once to a financial institution I had an account with, and received favorable results. You have nothing to lose by trying.
Me too...i guess they feel like they are losing a good customer.
Me too...i guess they feel like they are losing a good customer..one who made them a ton of money on overdraft fees. I swear, I am sick about it....
Contact Dept. of Banking
I would e-mail/fax your state dept. of banking and complain about National City. Tell them they refuse to abide by your request and let them know how this is affecting you financially. Also, I would fax a copy to the fraud dept of National City to the person you spoke and the person at the branch. Let them know "you're mad as hell and you're not going to take this treatment any more". I had to go to a second branch after the first branch manager basically said the same thing.
I was able to get the ACHs blocked and have my direct deposit forwarded to a new account. I would most definitely NOT open a new account with them.

Ok - just got back from the bank - my manager suggested that you contact the fraud department, she was puzzeled that both your managers were not willing to help. Explain to them that the are not licensed in your state to give loans.
Shazzers, what do you think about them contacting their local Dept of Finance as well - since the banks are bound by law to revoke the EFT's???
That way if they incur any NSF charges they may reverse them???
Which is basically what Aubrey suggested???
They are regulated by the DFI so definitely contact them.

OK, so here is my plan. Tomorrow morning I am going to go speak to yet another manager with this information in hand. I am going to insist on a hard debit block to be put on my account, my rights as a consumer. I will ask for a new account to be opened for my deposit. Sounds good, right? We will see what happens. What do I do when they try and give me this three way call bull...or tell me I gave access so they can not ever close my account...it will reopen?? I hate this.

I would go to the new manager - tell them that you have had fraudulent debits taken out of your account and you need to have them reversed and your account closed. Dont tell them that u signed up for the loans - just advised them that they are not licensed in this state and somehow they got your account information and they have shared it with others that are now also taking money out of your account. Tell them that you need to get this resolved right away.
Its not any other their business what you do with your own personal finances, dont give them anything that they can use against you.
Keep us posted on how it works.

I have been trying to work with National City since 7/31/09 - at that time I asked for a block to be put on my account, which they did, but it was then reversed and more debits came through. I now have 234.00 in fees on the account which I don't feel I should be liable for since I tried to close the account back in July when it was positive. They have now put a hold on my current account so that I cannot even use the money which I have deposited into it. Once this is cleared up, I am going to close the account go with a bank that has some customer service. This is now me dealing with 2 branch managers and loss prevention - in my opinion way too much to deal with.

I just closed my account with National City. If you call the loss prevention department at 877-459-3435 they can close your account as long as there is nothing pending. My account was negative and they could still close it. Which was a relief.....
But I'd call that number first before going to a manager. They deal with this situation a lot. Also you can start a payment plan to pay off any negative balance.
Hope this helps any other National City/PNC users!
