Hello, I am desperate here. I made one little mistake and overdrafted my account by almost 800 dollars. National City would not refund any fees. I took out several PD loans to try and cover this. Big Mistake! I used Cashnet USA for 200 dollars. They have low fees and I have used them in a pinch before. Then I got one from Payday One. They offer payment options, which of course are interst only. Here's the thing. My bank account was in a constant state of close to overdraft. I requested funds from my 401K and everything. I then notice a transaction from Dinero Funds for 600 dollars. After looking through all of the internet, I find out this is loan point USA. I never authorized anything with them. I called my bank and they said they couldn't do anything. I log into Loan point and find out I have an account (used my social and I was shocked), there is a loan for 600 dollars. I asked my bank to block ACH, they wont. I can't get in touch with these people. I never agreed to anything with them? What do I do? They are taking over 300 a month out of my account? National City said oh well, we can do a third party call with them. I said NO I want it blocked. I can't live with this and feed my kids and pay bills, they are sucking me dry!! I am in PA. I feel so stupid.

Print this out and show it to your bank:
Regarding the EFTA and Universal Debit Agreements..

Quote:

?? 907. Preauthorized transfers

(a) A preauthorized electronic fund transfer from a consumer's account may be authorized by the consumer only in writing, and a copy of such authorization shall be provided to the consumer when made. A consumer may stop payment of a preauthorized electronic fund transfer by notifying the financial institution orally or in writing at any time up to three business days preceding the scheduled date of such transfer. The financial institution may require written confirmation to be provided to it within fourteen days of an oral notification if, when the oral notification is made, the consumer is advised of such requirement and the address to which such confirmation should be sent.
(b) In the case of preauthorized transfers from a consumer's account to the same person which may vary in amount, the financial institution or designated payee shall, prior to each transfer, provide reasonable advance notice to the consumer, in accordance with regulations of the Board, of the amount to be transferred and the scheduled date of the transfer.

Regulation E
Section 205.10 Preauthorized transfers
Requires financial institutions to provide the consumer with some form of notice that electronic transfers that recur at substantially regular intervals, such as the direct deposit of salaries or benefits and the preauthorized payment of bills, occurred as scheduled.

These people are so rude at the bank and on the 800 number. They will not close the account. They say they will not even put a hard block on it. Where do I go next? I am willing to live with writing checks and using cash if I can get this ach revoked. That means, I cant use the debit card as well. We are losing our car and behind on all utilities..etc..because of this.

Go directly to the branch manager. They MUST abide by your eft revocation, that's the federal law. You need to print out the revocation letters you sent to these lenders and show it to the branch manager. Remind your bank you have every right to revoke any debits on your account. Ask if you can fill out a formal complaint regarding the revocations.

Thank You...I think I will try a different manager. I tend to think that National City cares more about overdraft fees than their customers. This is the first time I have had this problem. If it was not for me doing what they said, putting my boyfriends paycheck in at the teller so it would clear the next business day...well it didn't. They held it for three days (that has never happened) and all of these little debits cleared in that time..ughhh..no refund, no explanation. They really suck. My fault on the payday loan thing...but since it is my right, I am going to take this to them. They said for every stop pay, every time I would have to give them the amount, transaction name and pay 40 dollars! I hate them.
