National Credit Adjusters
Date: Thu, 04/03/2008 - 05:49
I obtained a response on my answering machine last evening regarding this letter and they stated that they would not deal with me via letter or email only on the phone. I thought they had to validate a debt and cannot expect to collect when you do not agree to the debt.
Please advise how to proceed. Thanks!
No Advice?
I previously sent a message regarding this company, no one replied...help, I have written two letters to them and they only want to communicate by phone. I do not remember/have any confirmation of the one debt and am requesting validation on both since I think I may have previously paid off one of these debts.
Can anyone assist?

HI there..
Per the fdcpa, if you tell them not to call you, they need to stop..and if you have sent them a debt validation letter, any calls and letters are considered collection activity, which needs to stop until the debt can be validated.
I dont know the context of your letter exactly, but I would send them this letter below, certified mail and add on the letter that you are logging all of their calls.

Re: ACCT#
To whom it may concern:
This letter is being sent to you in response to a notice sent to me dated
This is not a request for "verification" or proof of my mailing address, but a request for Validation of Debt made pursuant to the above Title and Section. I respectfully request that your offices provide me with competent evidence that I have any legal obligation to pay you.
Please provide me with the following:
1. What the money you say I owe is for
2. Explain and show me how you calculated what you say I owe
3. Provide me with copies of any papers that show I agreed to pay what you say I owe
4. Provide a verification or copy of any judgment if applicable
5. Identify the original creditor
6. Prove the Statute of Limitations has not expired on this account
7. Show me that you are licensed to collect in my state
8. Provide me with your license numbers and Registered Agent
At this time I will also inform you that if your offices have reported invalidated information to any of the 3 major credit Bureaus (Equifax, Experion or TransUnion) this action might constitute fraud under both federal and State Laws. Due to this fact, if any negative mark is found on any of my credit reports by your company or the company that you represent, I will not hesitate in bringing legal action against you for the following:
1. Violation of the Fair Credit Reporting Act-reporting inaccurate information
2. Violation of the Fair Debt Collection Practices Act-continuing collection activity on a debt which has not been validated
Also during this validation period, if any action is taken which could be considered detrimental to any of my credit reports, I will consult with my legal counsel for suit. This includes listing of any information to credit reporting repository that could be inaccurate or invalidated or verifying an account as accurate when in fact there is no provided proof that it is.
REQUEST FOR CEASE AND DESIST OF CONTACT BY YOUR OFFICE: I would also like to request, in writing, no further contact, either in writing or telephone be made by your office to my home or to my place of employment, unless it is to provide validation or release of liability of the debt.

They also never called me. I haven't heard a word from them again after sending the letters. I went ahead and filed a complaint against them with the BBB and my state AG.

As fasr as I know,NCA is a 3rd party collection agency and would just need to be licensed/bonded as such and they can report to the credit bureau. You would just need to disputed with the credit bureau and have it removed.

More people should file suits for fdcpa violations against them. Yourself included!

gard, they are soooo full of crap! You have every right in the world to request debt valildation. And, they are to properly validate that debt. They can only deal with you via telephone? My a$$! If they can mail you a letter stating that you owe them money, they can mail you a letter validating the debt in question. They never responded to my debt validation request - so to hell with them. I haven't heard a word from them. However, they never did have my telephone number. But I sure did file complaints with the BBB and my state AG against them!

I totally agree with Cannr on this. I supposively owed them money for a loan and they never responded to my request of validation. You need to file complaints. I'm telling you they are nasty and they are full of CRAP! Dont back down! Lisa Ray from NCA is a %itch!
National Credit adjusters
I am currently in the middle of a lawsuit with National Credit Adjusters. I am currently in pretty good shape. Do not respond to them except to send a cease and desist letter. Do not call them. They threatened me with jail, that investigators would come to evaluate my property for their taking. My wife is disabled and has a bad heard and they did every thing they could to scare her and she is not even the one they are interested in. They threatened charges for violating international banking laws. They are violating FTA rules and regulations and you can sue them and get punitive damages.
