I rec'd an disturbing phone call on yesterday from a law ofc located in NY--he immediately started threatening me, sayin I will be charged with 3 counts of fraud and I was going to jail along with my references, I do not recall having a loan with Advanced America, and when asked for proof, I was told they did not have to show me proof!! He told me they didn't want my money they wanted to sue for more money-said I recd $400, and tghat they were suing me for $5000--this scared me, what are my rights. I live in NC--they said I better get a lawyer!!! Then recd a call yesterday form Quikpayday on a loan in 2004, what is the time limit on these type of payday loans? Please help--this really frightened me--even threatened me with garnishment...thanks


What state are you in? Did this Attorney give you their name? Did you look up their phone number to see if they are for real? See, the problem with phone calls is, you never know for certain if it's someone playing a practical joke, or a scam, or even if it's a legit 1. That's why you should never admit to owing a debt over the phone. You can't go to jail for owing a debt, and this attorney needs to be reported to the FTC, BBB and your attorney general's office. Anyone who makes threats like this are the ones who need to go to jail. How stupid can they be threatening to put your references in jail, that's a BIG red flag right there, it's an outrageous and ridiculous threat. REPORT them! Ignore their threats because they are lies!

I contacted NC Attorney General's office and now waiting a call back -- I also contacted my bank--and they have no record of me receiving monies from Advance America, and my bank stated that they have received numerous calls from clients stating the same phone calls -- is this a scam? They had my bank acct # and bank name -- I am in the mist of changing my account number immediatley!! Can anyone tell me my rights in NC?

Calm down. It's a scam. If they call again, tell them to send you something in writing. If they give you excuses about why they can't, or won't, just ignore them. Reporting them is the way to go. Securing your account is also smart. You may also want to send them a cease and desist letter along with a wage assignment revocation (to be on the safe side).

Payday loans are prohibited in your state, please file complaints.
