NCS Threatening Legal Action

Hello Again. This is all starting to take it's toll on my mental health, I swear. So in late August this company, Nationwide Credit Services (NCS) called and left messages on my friend's and family's answering machines stating that they were looking to take me to court over a payday loan from VIP Loan Shop on charges of defrauding a financial institution and breach of contract. I spoke with them that day, scared out of my mind, and agreed to make a payment that day and set up a payment plan. I made $458 worth if payments before I got on this site and realized that what they did was totally illegal. They didn't give me a validation of debt that explained WHY I owed $1125 on a $500 loan. They didn't offer me any time to dispute the debt. They said the local authorities were going to come to my work and serve me legal papers.

So I wrote them two e-mails. One was a C&D letter and the second was ANOTHER C&D letter as well as notification that I filed complaints against them with the FTC and NJ AG's office. I told them they collected those funds from me fraudulently because they misrepresented the legal status of the debt. They never responded to any of my e-mails. I sent them a certified letter through regular mail, but never received the return receipt.

Anyway, this past Friday they were supposed to take another $333 from my account, which I blocked. So they started blowing up my phone. They called me yesterday at work, twice. I found a website called "saveyourcall.com" and enrolled so that I can record the conversation between us from now on. So I called today and she told me I didn't have her permission to record her... but obviously I did anyway. I told her they can't collect on a loan that was illegal in the first place. I told her that VIP Loan Shop is an offshore lender with NO legal authority in the US and that they're not licensed to give loans in NJ. I told her the contract between us was NULL and VOID, and she said it didn't matter, that NCS is in the US and they WILL take me to court and that I WILL have to pay the money to them. I told her I knew my rights and that I wanted something send in writing to my actual physical address, and I wanted a breakdown of the $1125 because I don't know WHY I WOULD OWE $1125 on a $500 loan.

Anyway, at the end of the call I was getting frustrated because we were getting nowhere. I told her about Western Sky and how the same thing is happening with them... the loans are unenforceable, but she wouldn't hear it. We were just arguing back and forth about the legality of the loan, and she basically said "OK we're going to file the papers to take you to court" and I said "OK do what you need to do then."

WHAT DO I DO NOW?! Are they really going to come serve me at work? Will a judge actually uphold a contract for some offshore predatory lender? Please help me. I went on creditlaw.com and filled out a preliminary free consultation form... they e-mailed me back and said they were confident that they could secure a cash settlement and stop this harassment. But I really don't want to take it that far. I just want this shit to be over with. Any advice is appreciated.


report NCS immediately!first to your local police then the FTC.this bottomfeeder can't/won't do a thing they threaten.in fact the calls to others broke the law habd over fist.you report NCS and ignore them have others do the same.tell then it is a scam pure and simple.just know this is a complete bottomfeeding pile of crap.

Yea, I got an email yesterday saying it was their last time contacting for the 100th time before they file suit.

I replied, if you're last email was the last email then why am I getting this one. See you in court!

And to spam it went.

I already had reported them to the FTC and NJ AG. I just called a little bit ago to ask them for their mailing address so I could send a certified letter, and they totally refused to give it to me. They said I could send it to them via e-mail. Well, I already did that THREE times, I told her. She said "oh we haven't received anything." Give me a break. Either way, she wouldn't give me the address. She kept saying "you can't dispute this debt. Are you disputing the fact that you received $500 in February from this company? No, you can't dispute this debt."

She would NOT give me the address. That's OK because I have the whole call recorded and I'm over it, I'm filing suit against these jerks. They want to push me, I'll push back harder.

Good work Kerri. Though I am not sure you will be able to find a valid address to serve them, you are doing the right thing pushing back. NCS/ACS/MCS needs to be put an end to.

Hello Everyone. I just wanted to say thanks again for your help. I received another message from this company yesterday:

"Good afternoon, this message is for Kerri... My name is Brendan Jones, an attorney from the NCS attorney's office, giving you a call this afternoon to inform you I will be able to give you 30 minutes to contact my office with a statement. After that 30 minutes I will go ahead and get the local authorities out on this case to take legal action against you today, starting with the address 1516, your current place of employment, which I've already contacted, you're not working today. At this point in time my number directly is 877-563-8684. My extension is 708. Also, if we can't locate you by these current addresses today, we'll have you located by any registered vehicles in your name. You have been notified."

Obviously, no policemen showed up at my door yesterday, or today, so far... lol. These people will not comply with any of my certified letters or requests. They still continue to call me at work at least once a day. I asked the people who answer the phone at my job to ask WHO is calling for me... and if they won't identify themselves or say they're from NCS, to tell them that I'm not here and that I cannot accept personal calls.

How can you deal with a company that you can't get an address for??

the exact way you are.your co-workers are great in the way they are handling these losers,but if you haven't file a police report do so.other than that keep ignoring their sorry selves.they'll tire of the responses grom your co-workers,and your silence.

don't know why you are #4 when you answered today,but of course they have no email,or address,or fax number.they are a bottomfeeder.stay off the phone.meaning if the numbers looks strange,or unfamiliar don't answer it,and delete the messages as they will just be threats,and scare tactics meant to get you on the phone.ignore them completely.

They told me that they didn't have an email. And have threatened me with coming to my house and job I don't even work
