Hi everyone,

I'm new to the forum. I need some serious help with paydayloans. I currently have 13 active payday loans. I can't afford to pay them anymore, all of my bills are getting more and more behind and I don't even sleep anymore. I have to keep taking out loans to pay other loan fees and it's getting worse and worse. My entire checks disappear to payday loans. These are the loans and amounts I have outstanding. How can I stop this madness? I live in California. Please help me!!! Should I close my bank accounts first so that they can't take money from me anymore and then work out payment plans?

Here is the link to your state's pdl laws. And on Sept. 8, 2006 CA ordered a cease and desist on all ipdls operating in CA without a license and lending to CA consumers at that time there were 40 ipdl companies on that list and they said they were adding more as they got complaints. So COMPLAIN. You will get out of this.

Yes! Close your bank account. But when you go to close it, ask your bank what their policy is on ach transactions going through on closed accounts. Some banks will force open the closed account and allow the transactions to go through. Then you owe the bank $1000's . . . Not a good situation. If your bank does do this, there are ways around it. Tell them your situation, that these companies are operating outside of the law, and that you need to close your account to avoid fraudualant transactions. Tell them to put your account on deposit only, an ach block, or a hard hold. Your bank should do at least one of the three. Don't take no for an answer.

Close that account before your next payday and ask yur payroll dept for a live check for a while. Can you please list what you have paid to the others. You have already paid the two of them way more than the law permits. You must take back your paycheck now but get ready to deal with all kinds of threats that are totally bogus. Below are the laws of California. Way below!

Ok, I'm so scared to close my bank account guys. I don't want to go to jail and I don't want my checks garnished. How do I proceed after closing my bank account? Do I write them letters?

I want to pay back to them what I owe, but nothing more, some of the companies have extracted thousands of dollars from me. Can these pdl companies take me to court in california?

I understand your fears, many of us had the same at first. Your state prohibits criminal prosecution for that. But yes, they will illegally threaten you with charges of fraud and arrest, that is false and they are only trying to scare you. Only the licensed pdls will take you to court an unlicensed one has no leg to stand on. Get your complaints in to your AG's office, read the link I provided above it will also give you more on who to contact for complaints.

You need to send the company a revokation letter stopping it. And you MUST give a copy to your HR person, because the companies WILL STILL send it in to attempt the wage assignment. And that is illegal, but they still do it, and you need a court order in most states for a garnishment but unfortunately some HR/payroll people will still honor the request. That is why it is so important to give a copy of it to the HR dept.

Hi again,

I just wanted to send a message to those who offer help in this forum to say thanks. After reading some of the posts on this forum I'm so happy to know I'm not the only one who's gotten stuck in this predicament. I am going to the bank tomorrow to close my account as you all have suggested and will then send letters to every pdl to revoke ach transactions and all wage assignments they may place against me and let them all know the bank account will be closed from here forward. I will let you guys know how it goes.

Also, part of my problem was letting my husband know about all this. he was aware of a couple of the pdls but had no idea it was this bad because I am in charge of all the monies in the house. What he did know is that we never had any money, and we make a lot of money between the two of us and my excuses never cut it. I just had a heart to heart with him and he was 100% supportive and said we'll fix it, #*$& happens. Thank god, I think that was the scariest part of this whole thing!!!!

back again!

Can someone help to direct me to some form letters to send to these companies? I need one for PIF/ illegal practices, one for ACH revocation and one for Wage Assignment revocation. I am in California, as I stated previously. I want to be as pro-active as possible. My loans will not default until the end of next week when they try to hit my closed bank account.

I live in California also and have internet payday loans. Do not file your complaints with the AG office because they will just direct you to file your complaints with the California Dept of Corporations, thats who you want to file the complaints with. Go to their website and see if any of your payday loans have a desist and refrain order against them because if they do your contract is null and void. I was lucky alot of my internet payday loans had the desist and refrain order. File complaints with the BBB also i got one of my payday loans to mark my loan with them Paid in Full. It does get much better i found this site in May 2007 when i had 9 PDL and only have 1 IPDL left that i am having a hard time with.
