No you can't go to jail for your bank account being overdrawn.

It would be in your best interest if you could work something out with that bank before they report you to chexsystems, where your name will remain in their database for 5 years. This will make it difficult for you to open up a new account somewhere else.

Wells Fargo is a tough bank. I am surprised they have not closed the account yet. Why have you not put ACH Block on PDLs. Also if you go in and talk to the branch manager and explain the situation I think they might help you out. They may be able to close it, and work out payment to them directly. It is worth a shot. Has it been overdrawn 30 days straight?

What I meant by fraudulant activity, is like writing checks knowing you don't have the money in the account, or ATM fraud (putting an empty deposit envelope in the ATM) etc . .
Payday loans would not be fraud.
A word of caution, WF is hell to deal with. They will not put an ach block, and they won't do much to help you.
I had an account there, and my purse was stolen. I went into the branch, talked to the manager, and had new accounts opened. Well, a bunch of transactions (not mine) still went through on the old account. As they were not mine and my info had been stolen with my purse, they reversed the changes and nsf fees. But they couldn't close the account until it had been negative for at least 2 days, and any new transactions would force it back open. This went on for a month, fraudualant charges being reversed as well as nsf fees.
Finally, loss prevention saw the account. They thought I was working with the branch manager to fraudulantly get all the nsf fees reversed. They closed my good account, fired the branch manager, and reported me to chexsystems for fraud. Nice bank.

Yep, I have heard many horror stories about WF. They are absolutely difficult to deal with. On the other hand, I think it is best "Guest" tries to pay off negative balance. That will be difficult if the PDLs keep hitting his account and NSF fees are incurred. Wells Frago has to do something, don't you think?

I have to give credit where credit is due. It seems like I have read alot of bad things about working with Wells, so I was scared when I went to take care of my account. The branch manager there put a hard debit block on my account (no questions asked) and called me every couple of days to let me know the account was okay. So I really think it depends on who is at the branch you go to :)

fifth third bank is the worst!!!! I've had a terrible time with them and the response I get from their manager is, Sorry Mam, I can't help you. We are allowed to charge as many fees as we can. And they receive money from American tax payers from the stimulus. They can all burn in hell

Fifth Third is where I had my account when I was in the payday loan mess. They were great in working with me. I went in talked to the branch manager. She put a hold on my account and refunded a huge portion of the NSF fees. I don't bank with them now, but that's only because I work for a credit union.
