NJ and PDLs

I get so confused about the laws on PDLs in NJ. I know that it states that they are prohibited, but I had called the NJ Dept. of Banking and Insurance a few months ago and I was told that there was nothing they could do for me and if I had signed a contract I needed to work out something with the lender. Now I call again and the woman I spoke with was telling me they are in fact illegal and that they cannot loan to anyone in the state of NJ and that they cannot collect legally in NJ. She did state the only thing she could do for me is I would have to write to NJDB&I asking for their assistance with the PDL co. meaning they would get in contact with them on my behalf and let them know they are operating illegally in NJ-she even gave me a tracking number for my complaint. It seems you get different answers when you call. I think I read that on some other posts as well. Has anyone else felt this way?


I also had the same thing at my local Attorney Generals office of Consumer Complaints-one lady tells me (I don't think she even knew what a PDL was)that a creditor/debt collector could possibly get my DL suspended if they took me to court. I am not stupid. I then did call DMV up and it took me 2 different people to go through to explain my situation and a supervisor until they satisfied my question-no one can suspend your license for unpaid unsecured debts-except child support, taxes. Good ole NJ and the state agencies. It is quite frustrating. When things are all said and done I am definitely writing our state government offices and will try to get as many people in NJ that have fell in the PDL loan trap to do the same and get strict laws put in place, NJ has dealt with only Predatory lending for mortgages and rent-to-own. They have specific laws on predatory lending to senior citzens and the handicapped, but not the common consumer on small loans. Thanks Goudah

I don't think NJ really cares about their laws. I just started receiving responses from my AG letters. Basically the letter states that they have sent my complaint off to the state where the Payday loan company resides. Well in some states it is actually legal. What does it have to do with another state when this company has broken the laws of New Jersey. I give up, my loans are paid to the vultures and I pay a loan every month to get out of this mess.

kolodin. . .nice to hear from you! I know that you and I have talked about the PDL situation and I am sorry to hear that you are having such a difficult time. I know I got the same bunk from the New York AG's office. Send us this, send us that but by the time they responded I had already gotten myself out of the mess. If they are illegal that to me is the end of the story. That is the bottom line that I used with the PDLs and that fact, combined with my relentless sending of my C and D letters and then the calls to the processors, produced immediate results from my PDL woes. Have you gotten anything positive on the PDLs which are still owing? Call the tatics that I used what you will but I don't owe a penny to any PDLs that I originally owed monies to. Please keep us posted.

Hey llw1995, actually this is the only one I am having difficulties with at the moment. The other one PDLYes is not bothering me as I did go the Processor way with them. The other ones that I morally owe, I refuse to give them a dime if they cannot provide me with a physical address so I can send it certified mail. I will keep everyone updated. I do want to thank everyone, I am glad I found this site, it is my life line and everyone has been supportive. There are so many scams and scums out there but I do believe karma(what comes around goes around). I will pay any debt I owe no matter what but I will not support the low life scums that work for a living stealing other peoples money. Again thanks to everyone for your help and support.

I had the same problem in Connecticut, by the time someone got around to calling me back, I had all but two PDLs taken care of on my own. The first person didn't seem to know what they were talking about, the second person said they were illegal.

Ldoll. . .that is exactly what I found with NY as well. Seems they are "tied" up with more important things at the moment. I had all mine settled before I actually got a written response asking me for additional info. I did send it but I also let them know that I was fortunate to settle them on my own.

Hi waterlu3, I have not gone to see the attorney as of yet, waiting for all my bank statements for the last year on a closed account to be sent from my bank, they should be here any day now. The attorney is Lawrence Rubin out of Philadelphia area suburb (Media, PA)he represents PA & NJ. He is experienced in fdcpa violations and PDL and debt collectors. I will PM you personally and let you know the outcome, its going to cost me some money, but I think its worth it.
