p2, you have overpaid them..do you want to settle? Personally, I would tell them (in Cannr's Immortal words) Bite me!! They would not see another dime from me. But it is your call. I have this company too..have way way way overpaid them..but they have not responded to me at all... Bottom line, you are the one who has to determine what solution would be best for you.

Oh my just talked to a really rude lady at UCL. I told her I wanted my account marked paid in full. She went on that I didn't even pay the 325 owed to them. I told them the loan was for 250, and she just went off that I agreeded. She told me she and her legal team were very confident that they were on the right side of the law. I told her she wasn't licened and she hung up.

p2, I know that email was from an MTE d/b/a. It's their typical form email "settlement" letter. I can tell just by looking at it. Do not accept it. Of course, every one of your pdl's is going to claim you owe more money even though you overpaid. Of course they are. Especially MTE d/b/a's (UCL). Do not deal with the people via telephone. Why are you subjecting yourself to this abuse? You need to respond to their emails with your original pdl letter you sent them. It states everything. It shows you've overpaid, etc. Resend it to them. Respond to every email you recieve from them by sending that email again. 20 times a day if you have to. Don't talk to them via telephone. That's just punishing yourself. They are illegal. You overpaid. End of story. Just reply to each email with your original pdl letter. They're idiots. They won't leave you alone. Just harrass the hell out of them as they are doing to you.
Cannr - I waited all day for your reply to this. I just knew it
Cannr - I waited all day for your reply to this. I just knew it would be full of good information and what I was waiting for most....the evil MTE face  and a big BITE ME!!!!

You know, it's really sad at how predictable MTE is. You can look at a letter or an email and not even state the company name, and we know it's an MTE company. You can give a portion of a quote from the letter/email, and I can recite every word that comes after it. Totally pathetic. And these are the ass wipes that claim WE use form letters. Geesh. I can recite their "settlement offers", I can recite their response to the BBB, I can recite their response to the AG. I'm ready to type them a letter and tell them to please be more creative, as they are boring me to death now.

This company is calling me about the loan with TJF which I overpaid. I told them this is an illegal debt, they have me on hold. What do I do.

It must be Churchill week..I received a letter from them Saturday. I drafted a debt validation letter. Along with the usual stuff I also informed them they were attempting to collect an uncollectable illegal debt and am stopping by the post office on the way home today to mail it.

Just talked to UCL, and informed them that I sent a letter, email and fax that all future communication is to take place in writing. They told me that they would no longer call and that they would not speak on the account anymore. I made sure to inform them that if they shouldn't attempt to collect this illegal debt through any means and to mark my account as PIF. She got pissy and I started laughing, and encouged her to view the law, and reminded that her company was unlicensed and illegal. She hung up. So hopefully thats the last I hear from them on the phone. Haha I acutallly get a high after talking to them on the phone. It feels good not to be fearful.

p2, they won't contact you via telephone anymore. However, watch them. Only contact them via email. They may or may not even respond. But that doesn't mean they aren't there. They're there. They lay in wait like a cougar. You can hound the hell out of them via email. They may respond. If they do, it'll be ugly. If so, good. Documentation of their crap. And believe me, it's crap.

And for some Good news, Pay Day Services, has marked, my account PIF. 4 our 8 have been settled. 3 UCL 500FC, and TJF/BMG(Sent to a real collection agency) are still fighting my overpayments and refusing to mark me PIF. The last one National Payday Loan hasn't talked to me.

p2, please only take what I'm saying as "me personally". You do whatever you feel is right for you. This is the same exact form letter I received from all my MTE d/b/a's. The same response they sent the BBB. The same thing they emailed to me. I also had overpaid every one of these. Like I said above, "me personally", I refused every "settlement" they offered. Now, they are still on my butt! But, like you, I had overpaid. And I'll be damned if I was going to give an unlicensed/illegal company one more penny. They already took too much. So, I personally (this is just me!!!) responded refusing their "offer" and explained (once again) that I had overpaid, wasn't going to pay them any more than I already had, and they still have yet to prove to me that they are licensed/legal. So... that's my story. Now, p2, you do whatever is right for you. Some people go ahead and take a settlement, even if they've overpaid, just get get rid of these jerks. And that's fine. Like I said, they're still haunting me. But I'm not giving them any more money. No way. But, whatever works for you is what you need to do. If you just want them to go away, then take the settlement. If you do not want to pay them any more money, then respond telling them exactly that. Your decision, p2. And whatever you decide to do is not right or wrong. It's what is best for you.

The good news first, 6 out of the 8 internet payday loans companies has marked me down as PIF. The latest was 500 Fast Cash, I was shocked, but being stern, not backing down and my letters had a lot to do with it, and of course the support from you great people here.
So to update everything the loans that have marked me PIF
500 Fast Cash - It took a while and I only received one phone call, and I followed it up with a letter demanding PIF by certain date or I would pursue legal options for the overpayments
World Wide Cash - Marked PIF after receiving first letter
Payday Loan Services - Marked PIF after they made one threaten phone call. Told them I had the law on my side and they would not see one dime from me.
Nationalpayday.com - I actually hounded these people to mark me PIF, They are based in Costa Rica, they finally did after sending over 20 e-mails and I threaten to pursue legal options if not marked PIF by a certain date
Apollo Funding - Once they got first letter I e-mailed them, it took them only one day to make me PIF, actually really only 2 hours.
National Cash Advance and Payday Loan Center - One letter is all it took.
Bad news TJF and United Cash Loans have not made the same arrangements. However they have stopped calling. However I don't care I'm happy and want to thank everyone here who help and offered encouragement through this difficult time. I'm actually saving money and putting away some each pay check, so that if I'm ever in a financial situation again I have other options. Payday loans are just awful and evil, but thanks to this forum we have a way to fight back. Thank you all and I will post when United Cash Loans and TJF cave in to my demands.
