I too received a payday loan about a year ago. Due to whatever (me being irresponsible mainly) I defaulted on it. Of course not without paying the numerous finance fees to extend the loan. Now they are calling me at work and harassing me becoming very vulgar and rude to the point that my boss and HR department has told them not to call back. Well today I received a phone call stating they were taking me to court and I had the option of either setting that court date around my schedule or letting the court set it up for whenever. They also stated that they could, this day only, send it back to the finance company and reinstate the loan and not worry with all this. Can a PDL company take me to court in the state of Texas? I know they cannot garnish my wages.


What company was the original loan from? Is this a collection agency calling you, or the original lender?

I am in Texas as well and yes, some of them are nuts and will bug you at work. If the loan was legal, yes, they can take you to civil court, but you would be served notice. A lot of companies threaten court, but if you know how it works, it isn't realistic. Most counties will let you search online at their JP office or county clerk to see if anything has been filed in your name. Also, they won't just call and tell you to set a court date, that isn't how it works. First they would sue you and you woudl receive paperwork either from a server or via certified mail. They don't call you to schedule a time to serve you, or warn you first either - that is not how process servers work, they just show up! Then the court in your county would set your date.

Sounds like they are full of it.

I would find a good cease & desist, if it is a collection agency contacting you and not the original creditor, and send it to them. Email, fax, mail it. Also I would contact the Texas State Attorney General & the FTC and file complaints - you can do both online.
