How does one go about dealing with online PayDay lender legally licensed in your state?

Hi all, I've been browsing these forums for a while. I live in the state of Alabama. So far, everything I've read pertains to dealing with illegal payday loans, however, I am in debt with some online payday loans that are legally licensed to lend in my state, I've already done the research. My question is, can I still close my bank account, and offer to pay back the principal + interest in payments without any repercussions? Any help would be great, thanks!


Since your lenders are licensed in your state, so you owe them both the principal and interest. If you want, you can close down your bank account. It would be better for you to pay back them the principal plus interest, if you can afford to pay in full.

You can usually work out and Extended Payment Plan with legal lenders, you will want to talk to their corporate offices.. or they may require you be in collections to work out a payment plan..I would still close down bank account and revoke their ACH authorizations and cancel any possible wage assignments you may have signed.. and ask that all communications be in writing via email or US mail - you can still use this link for guidance in how to do - just remove what does not pertain to your situation - http://www.debtconsolidationcare.com/paydayloan/dealingwith-illegallenders.html

Here are the Payday Loan Laws for AL:
Alabama Payday Loan Laws - State Legal Status
Payday loan lending is considered legal in the State of Alabama. A payday loan company is guided by the payday loan lending laws applicable in Alabama. Online lenders must be licensed in Alabama.

Loan Specifications
Maximun Amount of Loan - $500
Term of Loan - 10 to 31 days
Maximum Rate of Finance and Fees- 17.50%; 3% per month after default
Finance Charge for $100 loan for a 14 day period - $17.50
APR for $100 loan for a 14 day period - 456.25%

Debt Limits
Maximum Number of outstanding loans permitted at a time - None (A payday loan company can lend an amount of $500 at one time)
Permissible number of Rollovers - 1 (rollover)
Cooling-off period - Next business day after repayment of two continuous loans have been done
Repayment Plan - Yes

Limits of Collection
Collection Fees Amount - a) One NSF fee of $30; b) Court Costs; c) Upto 15% fees (face amount of the check) of a reasonable attorney
Criminal Action - Prohibited (A collection agency cannot file any criminal action against a payday loan borrower until and unless the check gets returned due to closed account)

Those are my lenders. 4 of them have storefront locations in Alabama, but all the loans were online. Can I close my account without any legal problems?

Debt is civil not criminal.. lots of reasons to have to close down a bank account..and no one has the right to dictate to you that you must pay directly from your bank account.. have you looked these all up to see if legally licensed to do business in AL? here is where you will go to see - Alabama Banking Department - http://www.banking.alabama.gov/# - I am fairly sure Speedy, Ace and Check into Cash will be licensed the rest I will recommend you look up.. how much have your paid to date on each of the others? which ones have store fronts in AL - I am guessing the 3 above and one other?

They all have storefronts. I want to make payment arrangements, but I don't know if I can afford to make payments to ALL of my creditors every paycheck.. I probably won't have anything left. What can I do? Can I pay 2 off at a time? Thanks!

Call the corp offices - tell them what you can do and go from there.. some may be easier to work out payment plans you can live with if you let them go into collections..
