I spoke to check smart they said they couldn't take payments. they i spoked to someone at their corporate office. he said that would be fine. they've called twice a day everyday for two weeks. the store front and corporate. i've explained that they can't call me at work and they still do. anyways, after saying i could pay half with this check and half with my next check, they went ahead and submitted the check anyways. the bank returned it nsf.
they have been the nastiest.

Are you sure it was a payday loan with Cashland? I think they also provide installment type of loans, but quite honestly, whether it's a payday loan or installment loan, no matter, I would still contact them and let them know of your dilemma, ask if they would be willing to place you on a payment plan, all they can say is no. Anyway, if you don't have the money and they won't help you out them I would send them a payment anyways, through the mail with a money order and an explanation of your situation. I would continue to do this until it's paid off, because most likely, by the time they would take you to court it will be paid off if you continue to make SOME payments (no matter how small) as often as you can. It would also be in your best interest if it ever does go to court, just make sure you keep a copy of all correspondence with them and send it certified return receipt via the mail.

I would do the same with them, pay what you can pay, when you can pay it, via the mail. Also, you do realize that you will need to close your account because of Magnum? Now that they have your account information it will never be safe again.

once i go to the bank, what do i say to them? i don't think they will open a new account since i'm in the negative. and they'll probably close my account shortly because of negative funds.
are they any banks in ohio that don't use the chex system?

I know that Woodforest has second chance checking, you can check for more at the link below:

Two things, I was in the same situtaion as you, I live in Ohio also. First of all, I had an account with US Bank and they are idiots. They eventually closed my account because it went negative. They refused to put a freeze on the account as PDL tried and or continued to take money although I told them not too. US Bank did not to listen or help me at all. I am now in cecxsystem as I owed US Bank $600 in fees alone.
Regarding Woodforest, in Ohio they are usually at Walmarts but please to research about them before opening an account I heard and read they give you 2nd chance checking but for a price. Their fees, costs and customer service sucks. So please do you home work. Now as I said I am in the chex system and Huntington Bank allowed me to open an account for $5. I applied online and was given an answer within 24 hours. It's worth a try.

I never had any problem with Woodforest bank, the fees were about the same as they were anywhere else.

I dealt with Magnum by faxing them a letter stating I knew they were illegal and that I did not want any further debits of my account or any wage attachments. I also spoke with them on the phone. We agreed they would debit the remaining principal of loan and mark me pd. in full. They did so and e-mailed me re: pd. in full. Good Luck!

Hello
I am receiving calls from SRS stating that they are taking me to court for a unpaid payday loan. I tried to reconcile to pay this debt and then I didn't have enough money to cover the check which I agreed to pay. They are stating they can press charges against me for the nsf check across the states lines. Can they do this? I offered to make a payment arrangement starting 12/06/09 and she stated that she will put this account on a 48 hour hold and they will then proceed to have my wages garnished? Legally can they do that for a payday loan? In the state of PA aren't they illegal? What is my next recourse of action? I tried to get her to send me information about the original loan and they stated I had that information. Told them no I dont have that information she wouldn't send that to me and she wouldn't give me the number for arrowhead investment. She said that I should be able to go to my bank and get that. I dont have that bank anymore. I know that I paid off or on this loan but arent sure how much I paid. She wont give me any information but that I owed $900.00 for a $300.00 loan. But when they wanted to settle they only wanted me to pay $268.00 .She stated they have my conversation recorded that I agreed to make the payment and the check was returned to them.
Please help!
