Payday Loan
Date: Thu, 01/21/2010 - 13:38
I probably got the advance, then when it came time to repay the loan I didnt have the money so the payment was returned, leaving my account in the negative status. Now the bank has closed my account due to the negative status.
The guy (who barely spoke English) told me a hundred times that I had to go to jail with the sheriff tomorrow and an attorney would be given to me. He also told me they have sent me 17 emails about this account and I never responded. I received 1 phone call yesterday which I returned today to find out all this information. He kept saying it was tooo late to try to pay it off that it was already sent to court.
I asked to whom the debt was owed and he said the name of some cash service. I asked who it was and he said it was a federally funded bank that could be running one of many cash places.
Here's my issue. I finally talked to someone who agreed to let me pay 1/2 of it off today. I did give them my new bank account information he said I had to fax in an apology letter as to why I didnt pay it before and a permission form to for them to deduct it from my new account.
I am not 100% sure who the money is paid to. I do know I owe a couple cash advance places for this reason but I don't recognize the name I was given. I am starting to think I made a HUGE mistake giving them my new account number, but I got so scared because they were asking where I was gonna be tomorrow cause the sheriff was coming with a warrant for my arrest and I didnt know what else to do. Please Help. I live in Ohio.
more info.
I just called them back and they said the money is owed to US Cash Services. After I gave them the authorization they said they would call back in half an hour if not to call them. SO I called back in half an hour, then I was told they would call be back again real soon. I waited a couple more hours and I just called back again and was told there is a technical problem within the office and they will call back tomorrow. I am afraid that I just gave my banking information to someone who is about to try to take money from me. Please help me what do I do now?

DO NOT give ANY personal information over the phone, EVER!! You can not go to jail for owing a debt, that is a civil matter, not a criminal one!

Further more, don't admit to owing a debt on the phone either, request documentation, but don't give them your name or address, if it's legit (and I guarantee you it isn't) they will already have that info. Don't talk to them again, hang up immediately, report this to the FTC and your AG!
Just great
Now what should I do. I know I do owe a payday loan and I have used CashNet USA to obtain the loan. These people say their company is called US Cash Services and owns a bunch of companies. They did have my home and work numbers. They knew the last 4 of my SS and my address.
I already faxed a paper stating I was sorry it wasnt paid on time and I was going thru financial hardships. AND I faxed a paper giving permission to the creditor to electronically debit my account for 1/2 the amount that they said was owed.
I think I may have made a bigger mess than before I answered the message.

Fax another paper and revoke it, EFT is revocable at any time. You will need to take a copy of it to your financial institution though.
Any legit company would not behave this way, I hate to tell you this but your account will never be safe again, it would be in your best interest to close that account, or talk to the bank and explain you have been scammed and need to assign a different account number to that account or close it and open a totally new one. Whether you owe money or not isn't the issue, the way you were threatened is a BIG issue. You have no clue if this is a legit collection agency, NO ONE should ever take a persons word for it over the telephone. I truly hope you can stop them from robbing you blind, you will need to get on this right away!

Also, make sure you file a complaint right away to the FTC (link in my signature) and let them know exactly what happened. Tell them you were pressured into admitting to owing a debt that you aren't even certain is yours or not!
OMG This is horrible
SO I faxed in the paper to revoke my authorization. I will go to the bank tomorrow to try to open a different account. What do I do if they keep calling my work? I am not supposed to have anything but emergency phone calls at work. How did they get my work phone, my home phone, my Driver's License and SS numbers? They even asked me if I knew "Sharon ^%#" (my neighbor) and Vickie (my Wife) they said those two people had to go to court with me as well.
I don't have a problem working thru this to get it stopped from the bank but how can I keep them from calling my work?

You can't really. What you can do is NOT talk to them. If they call, hang up immediately. The less you talk to them, the sooner they will stop calling, don't give them anyone to argue with. They will eventually tire of talking to thin air. Meanwhile, CLICK HERE to find out how to deal with illegal lenders.
One last ?
OK and one last question about this. Since I do have a valid fax number should I fax a letter telling them I now know it was a scam and demand that they cease all contact with me immediately. DO not call my home or work again. Also telling them I have filed a complaint with the FTC and the ohio attorney General and that online lending in Ohio is illegal?

I wouldn't use your fax line at work if I were you, once they obtain that information they will fax stuff about you to your employer.

My wife and I went through a similar situation. We had paid on a check loan for over two years never being able to redeem the check. Finally we let it go back the loan company contacted us and I told them if they felt that, after paying 5 times what the check was worth in interest I would be more than happy to meet them in court and take whatever the judges ruling was. We haven't heard from them since. If you've paid the interest to let the check ride and have paid more interest than the check is worth I'd take my chances in court. You'll have a better chance of dealing with them there than on the phone.

Same exact people called me...
These people called me too. They used the exact same conversation. You owe us... we call the sherriff...sherriff will come and arrest you...do you know xxx(my friend's name)... Basically I said I had never heard of them and if they wanted to send the sherriff to my house to arrest me, please do so immediately. Oh and "by the way when you send the sherriff make sure he has a copy of the paperwork so I can actually talk to someone personnaly and not some foreign guy that I cant understand". He threatened that he was about to 'push the button' that would send the sherriff to my house. By the end of the conversation I was laughing. Come on now, it was insane the tactics he was trying to use.
Also, I asked him the date of the deposit, looked at my account and it wasnt even there. Totally made up information.
I havent heard from then again. Yet.

Please do what Shazzers and the others above are advising; these outfits will do whatever they can to intimidate people into giving them money. However, as to them coming after you with the sheriff, etc., that's highly unlikely as they're more than likely not even located in the United States.
