Ohio banking regulation re:Cashcall

I called the Dept of Financial Institutions for Ohio today about the legality of what Western Sky & Cashcall are doing and the answer I got was it's legal as far as Ohio banking is concerned.

Justification is they are not regulated by the state of Ohio so there is nothing they can do about it. The guy told me I'm on my own.

I asked even if the originated "loan" is considered illegal; Cashcall (they don't have a license in Ohio) can buy the account and report on your credit report and act on it as if were legal. The answer is yes!

I am really shocked by this. Basically, if you accept money from an entity outside of Ohio they do not have to abide by the banking/lending laws in Ohio. Does anyone else see a disconnect with this agency and the AG?!?!

Good luck to anyone trying to find a way out Cashcall hell. If you find it send a ladder for the rest of us.


What they're telling you is that there isn't anything they can do about it. And they're right. They hold no power over these "sovereign nations."

What they aren't telling you is that, just as they have no power in the matter, the sovereign nation has no power over residents of Ohio either.

Ohiogal - I understand the no jurisdication on tribal (Western Sky) but Cashcall is presenting itself to be a legally backed entity. However this guy contends that Ohio can do nothing because they are not licensed in Ohio.

My question to him (and everyone) is if you do not go through a credit check to obtain funds how is it possible if acct is transferred can they report to any credit agency if the original transaction is not valid. They should not be able to show on my credit report!!

Credit Bureaus will not remove the history since the loans are legal and binding. While it may not be under your state laws, it is just like a bank loan that is exempted by state laws.

when you dispute the debt,and add that an AG complaints was filed.it works.file the complaint then dispute it.i know that has worked for others regarding this particular place.the complaints are the difference.btw my apologies i never strive for that,and apologize when it warrants.

thank you for the apology - I've been doing a lot of research on these loans and no where can i find that they are illegal. State agencies that i have contacted will not give me any firm answer, they will not outright say theya re illegal. I would love to share this with the comunity, but when i brouse the web, i always see nasty comments from people who you are disagreeing with, so i will not register. Best of luck to everyone!

the real issue is that cashcall took over an illegal"tribal loan"how each state handles it varies.i know my state of IL,and CA fight these places hard.i wish there was uniformity in how these illegals are dealt with.i still would file the formal complaint with your AG.just do it,and use that info to dispute the debt.when you call or email a question the answer you get might not be how they respond to a complaint as they cannot give legal advice/info via the phone or email.
