One Click Cash finally responded to the BBB. What do you think I should do? I can't pay the full amount they want by the date they want it. Thanks for your help. Below is the response I got. I did take out a $400 loan.

_____ is a repeat customer and recorded communication with customer verifies the terms and conditions were understood. In addition, this customer had every opportunity to print out her contract agreement when she applied and had access to it via password also. She had a 48-hour window in which to cancel the agreement and return the funds without incurring a fee. In addition an account summary was sent before each debit and it explained the terms once more and all of her options for repayment. This customer did not utilize any of these options. If she had wanted to avoid additional fees, then we needed to receive the account summary requesting this before the first debit date. We did not receive the account summary to pay this account in full before the first due date.
In an effort to assist this customer we can offer a reduced balance of $350.00 (She paid ZERO toward deposit of 350.00***THIS WAIVES ALL FEES***) until 02/13/09 only.

I can't remember but I am thinking you more than paid off the principal amount, correct? If so, then respond with a big fat NO. Explain that you will not pay anymore than your state laws allow, and proceed to include your state laws in your response. I don't know what they think they can do about it, sue you? I hardly think so. If they turn it over to collections, so be it, a CA can't collect an illegal debt. And besides, if they do turn it over to a CA then you can always ask them to validate the debt and prove how they came up with the amount per the fdcpa (Fair Debt Collection Practices Act), you can also request proof they are legally licensed to collect in your state. ah, just let them waste their time trying to collect, the laws are on your side!
