Emails to and from PA Banking Dept Hello, I have a question about payday loans in Pennsylvania. Does the small loan rate cap of $9.50 per $100 per year discount or 24% per year apply to these loans? I took out a few on the internet and am trying to figure out how much I legally need to pay. For instance on a $200 loan would I be legally responsible for paying back only $248? Thanks! Response: Dear Ms.: The 9.5 discount and the 24 % simple interest refer to calculations that can be used by companies that are operating in Pennsylvania and are licensed under Pennsylvania????????s Consumer Discount Company Act. With a number of exceptions, a lender that is located inside of Pennsylvania and who does not have any special lending authority (i.e., a special license or charter) who is making smaller loans not secured by real estate can only charge interest at a rate of 6% simple. A lender that does not have a physical presence in Pennsylvania but who has lending authority from some other state can generally charge the interest rate and finance charges allowed by that other state. The Department may or may not be reviewing this policy and I would not count on this e-mail as an interpretive opinion before starting any lending or business operations. There are no storefronts in PA. They are illegal. Internet lenders can lend legally to PA residents as long as they are licensed in another state. They would need to follow the laws of the state in which they are licensed. |
As for tha person calling you. Do you have the phone number...we can try to figure out who it is from that. As for the fraud charges, please relax, that is a threat companies make to scare you into paying them. As for them contacting you at work unfortuantely it is difficult to stop them. You may try having someone tell them you were fired.

Rob, another thing you might do is tell work that you have identity theft and that your information has been compromised. It worked for me. Now my office just puts them straight into voicemail.
Also, you will need to list all of your pdl's so we can tell you if they are even legal to lend anywhere. Also, the amount borrowed and the amounts that you have paid back so far.
The experts will be around soon...and will be able to give more advice...
Sorry to hear you are or were sick; hope things get better for you....the community here is wonderful and will give lots of support...
Take care and good luck.

Rob,
Check your bank statements; they will show how much you have paid so far...
I still think that even though you work for a state agency; tell them your information has been compromised and you may get harassing phone calls. And that you are trying to gain control of the situation; you just need their help to route the calls to your voicemail.
We still need the names of all of your pdl's, how much you borrowed, how much you have paid back and if they are storefront or internet.
I am no expert, and feel they will come around soon to give you more sound advice; but don't feel they can come and arrest you. These types of situations seem to be a civil matter instead of criminal...so don't worry. If you can get the information to us; we will be able to better assist you with your concerns.
Hang in there; we are here to help...

Apparently many people report having the same experience as you have. Do not let them scare you. Go ahead and send them a request for debt validation. From what I have read they are collecting for pdls as well as other stuff. Several people have mentioned them collecting for cash in minutes. Once you send this letter (I would also fax it if you can) keep track of when and if they call, who called etc. Purplegirl also gave you some good advice regarding dealing with the situation at work. That is what I told my employer and they were sympathetic.
