I live in Washington State. I took out a loan from papercheck payday loan about 3 months ago for $200. I can no longer afford to pay them but I already paid $300 in finance charges. Are they legal in washington state? Can They collect the rest of the loan if I default?

All sorts of PDLs are prohibited in your state. As a result, you're not legally bound to pay a single penny more than the actual amount borrowed from the lender. You can contact the Department of Insurance, Securities and Banking to inquire about them and file a complaint against them. This is incorrect, NOT ALL pdl's are illegal in the state of Wa. We need to know if the original poster obtained a store front loan or Internet loan before giving this type of advice, this could cause a lot of legal problems for the original poster if the lender is a store front lender.

I took this loan out on the internet. I did not write or send any copies of any checks or anything at all. I just signed the agreement over the internet and the money was sent the next day.

Thanks for clarifying. I checked the payday loan licensee data base in your state and papercheck payday is not listed, this means they have not obtained the proper licensing to issue payday loans to your state residents. Therefore, you need to close your account, because now that an illegal lender has your account information it will never be safe again, CLICK HERE to find out how to deal with illegal lenders.

I wrote the letter two days ago and e-mailed it to them, but still no answer, I've been ckecking my e-mail everyday. The loan is about 3 days in default and it just surprises me that they havent try to contact me yet. I did tell them that the only way I was dealing with this was over e-mails. is this a bad thing or a good thing?

Probably not. The best way to get them to stop calling is to file those complaints. They will eventually tire of calling you if you ignore the calls and continue to communicate with them via email/U.S. mail but, since they're an illegal lender, there's not much you can do to make them stop calling.

Although we on this website advocate paying back what you actually borrowed, in Shorty's example, we don't advocate paying $400 for a $200 illegal loan. That is highway robbery, and our friend might as well have had a gun next to his head, imho.
He needs to pay back his $200. Nothing else. And in his case, he's more than done that.

PDL, go spew your ignorance elsewhere. Most people got involved with these loans because they had a desperate need. They didn't know they were illegal until they got so caught up in the cycle they were drowning and had to seek help.

Do you honestly think it's ok for a company to loan you $300, take $90 out of your account every two weeks for a year and a half (which amounts to a little over $3500) and then tell you you still owe them the $300 on top of what you've already paid? That's what happened to me and it's BS!
