I was just laid off from work, and I am unable to pay the full amounts of my loans, is there anything I can do, so my loan wont default, or so that the bank wont pursue any legal matters??? Can I make small payments to them?? Any help would be appreciated,

Chris, Welcome. Would you please post what state you are in, whether you have internet or storefront loans, the names of the companies, how much you borrowed from each and the total of what you have paid each company. (example: Cash et - borrowed 200 - paid 300)
Listing these items will assist us with helping you

Actually I have paid, 200.00 to Quick Cash, this is just interest fees of course, and I have paid Check n go 107.00 , lat4 fees also.
The other loans are new, my payments arent due until 10-12. I was gonna pay them as I promised, but I just got laid off Friday. This is why I wont be able to pay them. I was even thinking about closing my checkings account cause I cant afford the NSF fees if they try and take out money that isnt there. Is there anything I can do?? this is so embarrassing. But i have no where else to turn to.

Please do not feel ashamed. We have all been where you are now. Please read the sticky at the top of this forum regarding closing your account. Your laws do not give specific info , as to prosecution. Be sure that is ok to close your account before doing so. If you do close it , we suggest opening a new one at an unrelated bank, just to be safe.

I am so sorry you got laid off! It is a difficult thing to go through. You need to pull the money out of your checking acount and close it before the next ACH attempt. Reopen another one at a different bank for now. Then start dealing with these places on your own terms. You can ask until you are blue in the face but they will not stop hitting your account. You are going to have to hang on to your money for necessities. Are you eleigible for unemployment compensation? Some states will pay for schooling if you need it while you are collecting if you want it. I have gone through lay offs and you will find out how creative you can be finding ways to earn extra money. We can help you with that too! Just start a new thread on how to earn extra money while not working. You will have the time to explore new possibilities. Try to turn this into a positive experience. Look for that new door that will open for you.

Hi Christina! Welcome to the forum. I know you are in a difficult situation right now, but things will get better. I am sorry to hear of your layoff, but frog is right...start a thread on here and I'll bet you come up with all sorts of ways to earn extra money. But, first things first...get that checking account closed if at all possible. It will be much easier to deal with these people if you have the upper hand. AND believe me, when you cut their access to your money, you will definitely be back in charge. Please register. This site is a great source of support. :-)

Hang on. Christina has a storefront pdl. This storefront has an actual check from her. She needs to find out what will happen if she closes her bank account with an outstanding storefront check. In some states it's a big problem if they turn your check in to find the account closed. The store front pdl needs to be addressed first.

Where can I check and see if it is legal for me to close my bank account to stop those withdrawals from the pdls?? Can anybody help me??? I do really appreciate everybody's help. Oh one more question, can I go to jail for not paying these loans on time?? That is my biggest worry.

Oh, I did inform some of the banks already and notified them that i was laid off and if I can mail in my payments, and two of them were okay with this, but as I have read in previous subjects, Check n Go does not allow payment arrangements. I also read that geneva roth can get my bank info, Im afraid now.

I just called check n go and they told me I need to make a payment by mail but I need to call and give them a reference number on the day that my loan is due, and If I dont they are still going to try and withdraw the money. I told them I was going to be closing my checkings aocount. I cant afford to pay them the full 425.00 with my last check. Whats the worst that can happen?

christina, we can help you. Do you have your storefront pdl taken care of? So that they will not turn your check in to the bank? Did you make arrangements with them? If not, please do that now. Your check 'n go that is legal - you have contacted them regarding payment. Just make sure they get a payment. If they can't get it through debit, just make sure they get it somehow. Just don't "not pay it". Send them payments. When you send them, call them and tell them you are sending xxx dollars that day. Keep in communcation with them. Anyone who is legal/licensed, keep up the communication so you won't get into trouble. Okay? Geneva Roth is not licensed/legal. They are going to "mess with you", but they are illegal. I do have a letter for you to send. I personally have emailed/faxed/mailed all my pdl's. Email usually gets you the first response. I just do it all. But when using mail, send it certified. But also go ahead and email it and fax it also. Cover all bases. Now, I do have a letter that you can use. However, here is the problem. You need to register as a member. You can register as just a member. You don't have to register for the free consultation if you don't want to. But in order for me to send you anything, you need to become a member. Once you do this, we can send each other messages. And I can send you a letter to help you. Okay. See if you can register as a member. I'll be checking back. Then I'll tell you how we can send messages to each other. Okay? Try it and I'll check back and see if you're registered. :D

What kind of a response did you get from them when you emailed them the revoke authorizations??? I was reading about SJM from another posting, and I have an account with them also. But I did email them and explained my situation to them, they send me a response saying i could mail in my payments and if icould not pay the full amount it was okay i just needed to let them know how much and dates that i was going to be sending them. They gave me a west indies address to send the money order to. Do you have any inof on them? they wer reallynice it seemed.

chris, I see you registered. Great! :D Now, as far as your "west indies" friends, they are so illegal. So very illegal. So incredibly overseas illegal. Okay. Sure they seemed nice. Because they are going to take you for more money than what you borrowed. They are using SMJ as thier name?

I can't find anything on OSL Marketing. Do you have contact information for them?

Also, I received your pm. I'm going to send one to you to be sure we are "connecting". Let me know if you receive it. :D

I just received a reply from SSM Marketing regarding my revoke authorization letter. it is as follows,

Quote:

RE: You????????re Complaint

Christina Duarte September 27, 2007
Account # 13910

We have received and reviewed your correspondence regarding your complaint with SSM Group, LLC.

While the information that you have collected may apply to companies that have physical locations in your state, it is our opinion that it does not apply to our internet business model. This is based on sound advice from our legal department.

The money was lent to you in good faith with the understanding that you would abide by the terms detailed in your loan contract. We upheld our end of the agreement by crediting the funds to your account in a timely manner. The Loan Note and Disclosure that you e-signed and thereby agreed to is very detailed and clear so as not to cause any confusion to the borrower, and meets all the Truth-In-Lending and Reg Z requirements as prescribed by Federal statute.

Upon review of your account history, you clearly knew all terms and conditions of your loan. We have all the legal contracts you signed, in which you agreed to terms and conditions of the loan.

Thank you for your time and consideration in this matter.

Respectfully,

Compliance Department

What do I do now?? I did email them and I said I am willing to pay them back, but only in payments and by mail only. I asked for themt o give me a legitimate address. I also asked for them to enforce my revoke authorization. I did file a complaint with the BBB.

PLEASE HELP, what do I do???

Chris-What is the address for these people??

With regards to the letter...the line that sticks out in my mind is "....it is in our opinion"....OPINION. So in otherwords the FEEL that the pdl laws do not apply to their "..internet business model"..you mean internet rip off model?

Their letter is subjective AT BEST! Do not be scared....it is a scare tactic. They quote Reg Z and Truth in Lending..that applies to the forms and anyone can download those forms from the internet. They are not special because they use them.
