The collection Agency for the Online Paydayloan company is threatening to contact my employer to garnish my wages. Can they do this? the company is Payday Customer Service on behalf of Arrowhead Investments.


What they are talking about is a "wage assignment". When a consumer signs up for a payday loan they sneak in something that you sign that states if you default on the loan they can attach your wages. The good news is, it's revocable because a wage assignment is voluntary. So, all you need to do (very quickly) is write them an email such as this:

I hereby revoke your right to ANY wage assignments I may or may not have signed with your company and any of your affiliates, a copy of this letter has been given to my employer so any attempts you make to attach my wages will be denied, per federal law.

Make sure you print it out and take it to your employer! By the way, a garnishment can only happen with a court order, and Arrowhead or the CA doing the collecting wouldn't have the nerve to walk into a court of law. Send the revocation letter asap!
