I am wondering if someone could give me some advice on my current situation.I took out a payday loan over the internet with Paydaymax.com.I live in North Carolina not sure if it is legal or not.It started in October of 2007 and currently a payback pending, the original amount was $200.00 and again the cycle starts it eventually, it capped at $680.00 every two weeks, being a man of my word I agreed to the terms.I have had no problems other than the crazy amount I have paid, the last ACH was to come out on 15th but didn't came out on the 16th, causing NSF and a $29.00 fee, I got a call from someone stating they need my soc sec # sd no and they went into the threats.I asked to stop the drafts and I would mail a check, no physical address have to quick collect.I am not sure what they are planning to do now, I can't afford to pay continued NSF charges, also after paying $5,900.00 in interest fees, I had to stop and ask for help. Thanks

some facts about this pdl,and your situation.

1)all pdl's are illegal in NC
2)paydaymax isn't located in this country,so they are illegal anyway
3)close or put your account on DEPOSITS ONLY status.5,900.00 in fees?you not only owe them nothing, but they owe you big time.
4)file AG complaints against this illegal bottomfeeding pdl asap.
5)know that NC is a non-garnishment state so if they threaten that laugh in their face.

those are the facts regarding this pdl.please secure your account.

I will adjust my checking account right now. How would I recover any of the fees? Do I need to get an attorney? I asked for a physical address and they refused, the person continued insisting I give my soc sec # at that point I just said hey give me yours and where are you? Would not give me any information told her I would call back when I found out why the ACH was returned, I asked her for a name and she said that anyone who answers could assist me. Thank you so much for your help, without this forum and your advise, I probably would still be lost and broke, had to get two part time jobs to keep up with all of the fees, because they submit two ACH transactions it caused my Overdraft protection to kick in which is $25.00 per transaction, so that happens at least 4 times per month for a total of at least $100.00 on top of the interest fees I spoke of and no use of my checking account because it always keeps it in the negative. It is kind of difficult to accept the fact that I work 72 hours per week just to pay fees, it seemed a very quick and basic concept, never would have imagined that that first $200.00 would eventually cost me close to $9,000.00 but didn't have the funds just to stop the madness, again thanks for any help!

well get the account secured.speak to the manager to get this done.then file the AG complaints.as fars as getting all that money refunded.you can try,but being as illegal as they are they will fight you on it.just know anything they e-mail or call about will be illegal stupidity.you owe nothing, and they can't do anything but call and threaten.

Thanks again for your help! I don't want to get too hopeful or optimistic but any monies that could be recovered would be great. I would never have imagined that the original $200.00 borrowed would end up such a disaster, do you know how it works to try to get money refunded? Does the AG's office help or do I get an attorney? I didn't realize it was illegal and now wonder why my bank didn't stop on not allow the ACH to go through causing their fees to generate.I was just tryig to do my part as agreed, not only the loss of money I could no longer help my mother with medical bills, the reason for the small loan to start with, I had to move from my house to smaller apartment and borrow a few dollars here and there to buy gas and a small amount of grocery, I asked if I could just make payments and was pretty much advised I would be in more trouble, felt like I was being held hostage. Again thank you for your help, it's nice to know there may be hope to end this madness and there is some support.

your AG should be able to assist if you request that.they just need a phone number.an attorney will need an address to send any documentation.that could be tricky as their address is not in this country, and there seems to be no verifiable address.see what your AG can do before seeking an attorney.

Wow, just got off the phone with the AG's office, they made me feel worse than having paid all these fees.Explained situation and the man told me they have to literally close the office on Thursday and Friday to take these types of calls and they were consumer protection not debt relief, basically told me I was stupid, should have known better and now I was going to start getting calls etc. and that they may even call my boss and explain that I broke some type of federal law and they would call co-workers etc and I probably would loose my job because nobody could get work done because I screwed up wanting to have more money than I made.Told me I was the mafia's cash cow and there is no telling what my money was used for, I guess that's why these PDL's can continue because of these types of people who I thought are supposed to help.

I have to file a report and they put me on some sort of list and send me a letter, guess I am the criminal now, kind of makes you feel like dealing with the other folks at least they didn't tell me I was a grown man and they were not my mother or father and I was on my own, gheez. Thanks again Paul, keep you posted!

take a break this weekend, and try the AG'S office again on monday.if that idiot answers again get a name and report them.btw enforcing their pdl laws is consumer protection.if the person who said that doesn't like it they can be drummed out of that job.what a drillrod!!!!!!!!!!!!!try to talk to somebody else or email your complaint, but get the name of the drillrod that said those things.they don't belong in the AG'S office then.
