payments to ca collecting for pdl

I recently set payments up with a ca for one of my payday loans. The amount was to be for 250 to be split up into a few payments. Looking back over my stuff I realized that I had already made payments to the original payday loan that I had forgotten about. Now my question is with the next payment that will go to the ca on friday and with what I have paid in the past the amount will be more than what the origianl loan was for, I'll still have another payment scheduled with the ca. Do I need to make this payment since the payday loan laws for my state, NY, say that only the amount borrowed will need to be paid back. The orignal loan was for 200 and I made a 30 payment to the pdl and a 75 payment to the ca. My next payment will be for 125, would that cover the balance? Do I still need to make the additional payments that I have scheduled? If I don't can they sue me or anything for the remaining 75 that I have scheduled with them? Thank you for your help.


It was for an online pdl through sds processing. The thing is I've already made a payment to the ca so I don't think I can still request for it to be validated. But with that payment of 75 i paid plus the amount paid to the pdl of 30 and I now have a payment scheduled for next friday for 125 that will have more than covered the 200 that was originally borrowed. But the ca wants another payment after that of 50. So do I need to make that final payment if the 200 has already been paid? are the laws different for the amount to be paid if the account was sent to a ca? I know if it was still with the origianl pdl I could just pay the 200 and be done with it.

The point is, you shouldn't pay a red cent to the collection agency at ALL. They are trying to collect on an illegal loan and you do not have to pay them.

If you've already paid the OC the $200, you're fine. If you haven't, you need to. You also need to file complaints with your AG's office, the BBB, and the FTC.

Nothing in writing. I paid the ca 75 last week and I have a scheduled payment of 125 set to be paid. So that would be the 200 that was borrowed from sds (which i had already paid 30 to before they sent me to collections). But they want another payment of 50 after that. But the way i figure it I'll have paid 230 on a 200 loan, also i live in ny so i know they are illegal here. I just want to make sure that the same thing applies whether it's a ca or the original lender.

You are in the right, I just wish you wouldn't have sent a collection agency money, you don't even know for sure if they have the right to collect it. You're from N.Y. where payday loans are illegal, so, it bothers me a little knowing that you are sending payments to a CA that has never even validated the debt yet.

I know and I know that too, I have another one that was sent to a ca that I'm having them validate. So I'll see how this works out pay them the 125 and that'll be 200, actaully over 200 and go from there. Thank you again for all your help. Almost done with getting out of this mess. Got the one in collections and two more after that so I'm sure I'll have more questions going foward.

I was in the same situation (before I found this site) and all I did was send a letter to the CA stating that they were collecting for an illegal PDL and gave the laws of my state etc..and explained that I had already paid XXVY amount ... I haven't heard anything else from either the CA or the PDL. I did not get a PIF letter like I requested but at least I am not being harrassed so I guess at this point I will take what I can get.
