Hello I have tried everything possible to get CashCall off of my cr's, but to no avail nothing has happened, the cr's claim the loan is valid. I live in North Carolina and have sent the state laws and just about everything you can think of but they come back and say the loan is valid. I have even spoke to the AG and he said just pay the principal, based on principal I only owe $325 but I just received a letter from Delbert Services saying I owe $1097 and they will report to my cr's also. Should I pay the rest of the principle and demand a paid in full? Also what else could I do to get them off of my cr's? I am in desperate need my score has dropped dramatically from this. Thank you very much.


Cash call is not a pay day loan. it is an installment loan. It is a valid loan

Cash Call only supposedly services the loans for WS Funding, LLC who ever they are since no one can get or find any actual contact information for them.. They are legal where they are licensed to do loans of this type in most states they are only licensed to do mortgage loans. Western Sky not licensed to do business in most states and tribal - illegal... not valid loans...

And correct me if I am wrong but isn't Western Sky - tribal and unlicensed and then thy 'sell' the loan to Cash Call - But Cash Call also does their OWN loans in California, so I figure they are legal there? Just was looking for clarification to the above post?

Can anyone answer the question as to how to get them off the cr's. I have tried everything from complaint's to sending the state laws in but nothing is working. Everybody talks about it but what can I do what can I send in? Thank you.

I just got a letter from Delbert Services too....they are claiming I owe $4,076. I had a $2,600 loan that I have paid almost $3,800 owing them nothing. I have been fighting to get this loan declared PIF since August, have filed all complaints imaginable and have disputed with CRAs multiple times. I'm getting nowhere. I know that this is an illegal tribal loan - even Delbert acknowledges that it was issued by WS and is serviced by CC - do I go ahead and send a dispute letter to Delbert vehemently disputing the illegal loan and demanding a refund from their "client" - we all know that Delbert is an inside collection agency for CC......The last settlement offer I received from CC was for $1,700, which I rejected because I have already overpaid on this illegal loan. I'm so fed up with their ability to get away with these illegal loans and reporting them on your credit report. Anyone out there can direct me to a strongly worded letter telling them to bugger off?

Western Sky Financial does not have a presence in any state in the US (this coming straight from their legal counsel). Cash Call is merely the "loan servicer" and does not own the loans. Either way, Cash Call is not licensed in my state and most to issue anything but mortgage loans. They claim the loan is owned by WS Funding, LLC but no one, including the FTC has been able to locate any information about the entity. It is all a bunch of smoke and part of their "rent a tribe" scam to skirt state payday and usury laws. Their loans are only legal on their reservation.....funny thing is they do not offer these predatory loans on their reservation.

FloridaGirl - I'm in the same boat. I have been disputing with the CRAs to no avail. I'm working on my FTC complaint against the CRAs for allowing Cash Call to report the illegal loan. They cannot garnish wages (unless a misinformed employer falls for their tribal garnishment orders) and I can't find a case where they have sued in a state court over these tribal loans, I'm guessing because to do so would mean they would "have a presence" in that state and all their claims of we don't have to follow state laws would fall away. It seems the only thing they do is hold your credit report hostage with their negative reporting.

@ nygirl - I don't know about your state, but I know now that Western Sky/ Cash Call is not licensed in my state to do loans.. Most of the loans were by Western Sky which is illegal due to being tribal and unlicensed to lend in most if not all states. I never had a loan with Cash Call - but they are trying to get me to agree to pay them!

I also had a "loan" with Western Sky and made a few payments, which when all added up, amount more than what the original loan was for ($1,000) and the $500 upfront "fee" they charge... so I have been disputing their reporting to ALL credit agencies and nothing has been done. I have reported them to my state (Florida's) AG's Office, Dept. of Financial Regulation, and they respond by sending a very long letter from their "attorney's" offices indicating that they are protected by the tribal law, blah, blah, blah...
But their entry still shows on my CR.
What now????
