You could not get a new checking account because most probably you were placed in Chex System. You remain in that for 5 years. We have a banking forum which may help you find a bank that will give you a new account.

Long, I remember you...I am sorry to hear things have gotten rough for you. Cannr is the one who is familiar with storefront pdls in KY..she should be along suring the day...plese check back. From what I understand from most of her posts, they will usually refer you to collections....have you been through collections with them? Also, please do as Kash asked and list which companies you have to refresh our memories. That way, we will all know which comapnies you are dealing with and people with experience with those companies can help you out too.

Can I be litigated if I *offer* to make a reasonable 10-20 dollar payment? If I'm *trying*? The problem is these people are asking for much larger payements than I can make (110 payments and above). I'm not sure if they would even take a lower payment than that, but would they, and if they would, could I avoid litigation? My credit's already dead, so I have few worries about that at this point.

Hi, long! I remember you from before also! Sorry to hear about this pdl mess. Sometimes it seems like it will NEVER end, but it will. Cash America will just turn you over to a collection agency. They usually do that right off the bat. They don't try to mess around with the customer. Off to collections it'll go. With luck, you can work out a REASONABLE payment plan with the collection agency. You should hear from them once they turn you over. Quik Cash is a pain in the a$$ to deal with. You're best bet with them is to call the corporate office (I swear to you! I did and they worked with me very well.) Call the corporate office and set up payments with them. If they say they have to turn you over to collections, then let them. You can work out payment arrangements with the collection agency. Mister Money will be AWESOME to deal with if you call their corporate office. They were amazing. They will ask you how much you can afford to pay and when can you pay. They are really good at setting up payments. So, Cash America will just turn you over (let them and make pmts with collection agency). Quik Cash - call the corporate office and see if they will set you up with payments. Mister Money - call the corporate office and I know they will set up payments with you. Cash Tyme, I've heard, can get ugly. However, criminal action is prohibited in our state. But they MAY (I'm not saying they will) threaten you with court (it would be civil court). I've heard they are not easy to work with. Checksmart and Check Into Cash - I'm really not sure about. I haven't dealt with them and haven't heard of anyone who has (that I know). I would try the approach of calling the corporate office of each one of them and see if you can set up payment arrangements. Some of these places will surprise you at how well the corporate office will work with you. Give it a shot. I'm just passing on knowledge of the ones I've dealt with or know others who have dealt with. If you have any questions, just post! :D

Thanks again Cannr. I just hope it's not too late. I was sitting on my laurels for awhile, hoping I would get enough from my tax return to pay them off, but of course my return was almost nothing. Now these places are saying I will "charge off" very soon. (Check Into Cash says tomorrow - oh god.) I hope that doesn't mean that I will be served papers soon. Has anyone on this site ever been litigated?
Honestly, I just have not been able to make the kind of payments they've told me about so far. But my intention is to call all these guys tomorrow and the next day. We'll see what happens, I guess. *sigh*

long, one storefront I've dealt with here (not one of the ones listed though) has huges BOXES of "charge offs". You would be amazed at how many they have. So, one day I asked what the heck do they do with all those? I was told by the manager that they send them to the corporate office. So, it's not like they send them out to drag people to court (at least I wasn't given that impression!). Honestly, I know MANY people who have defaulted on storefronts here. And not one (that I know) has ever been taken to civil court. They've all been able to make payments. The storefront just wants their money. The storefront manager is going to be "tough" because they want their numbers to look good. However, once corporate gets ahold of it, they almost always work with you. Like I said, they just want their money. Call them, tell them NO WAY can you make these huge payments, deny having a checking account (so they can't say "rewrite") and pray for the best. They might try to scare the crap out of you, but I'm thinking you'll most likely get sent back to their corporate office for collections. Please, please let me know how it goes.

Settlement
Try to get a settlement in writing. Before you offer to make any payments, you must get this settlement in writing. Usually 50 cents to every dollar. For example: If you owe $500.00 offer to pay 1/4 of that and more then likely they will settle on 50%. The local store, will more then likely not want to settle with you, however the corporate office as well as a collection agent will. They will rather get something rather then something. Just stress to them that you can't pay a dollar more then a 50% settlement and be persistent to get the settlement in writing. Good Luck!
