pdl help in SC

I have been reading some of the posts on here and it looks like you all may be able to help me. I live in SC and have the following pdl's, all internet. Here is what I borrowed and how much I've paid so far:

GRC Funding- borrowed $500, paid $1,080
DJR Group - borrowed $300, paid $630
Mesa Financial - borrowed $300, paid $720.00
Eastside Lenders- borrowed $300, paid $782.50
PayDay Services - borrowed $400, paid $975
NationwideCash - borrowed $600, paid $450
AmericashAdvance - borrowed $1,000, paid $400
500 FastCash - borrowed $400, paid $120
integrity advance - borrowed $500, paid $150
OneClickCash - borrowed $400, paid $0
Cash Advance Network - borrowed $400, paid $0


Can you tell me if they are legal in SC? I have read the link to SC pdl laws and they all appear to be illegal. I just need verification. I have stopped my direct deposit and am planning on closing my bank account tomorrow. Thank you

Can you mention the link from where you found out that these lenders are not licensed.
I think that most of them are illegal, because under the SC payday loan laws the creditor can lend you a maximum of $300, but they have lend you more that the maximum amount. If they are illegal, you need to pay them only the principle amount borrowed and not the interest and finance charges. You should immediately close your bank account so that they cannot debit your account further.

Payday lenders must be licensed in your state to lend to South Carolina residents, I don't think any of yours are, bu I'm not 100% certain because I don't have time to research them right now. As stated above, check with the South Carolina State Board of Financial Institutions at (803) 734-2020.

I would just use them as a sort of guide, it's probably best and would make a greater impact if you use your own words. It doesn't need to be fancy, just tell them the facts. There have been too many unlicensed lenders recently complaining that this particular letter is circulating around the Internet and incorrect. lol The ding bats! That's why I would recommend you use your own words.

Don't mean to be ignorant, but I guess what I need to say is the I financially can not afford to pay any more, reference SC law re: pdl's and tell the ones I owe money on the principle that I need an address to mail the $ and the one's I overpaid to send me a pif and refund. Does that sound about right?

Well, I e-mailed letters to my pdl's. Below is a response a reveived from eastside lenders. I borrowed $300 from them and have paid them back $782.50 to date. How should I reply back to them? Here's ther reply:

law. On the advice of counsel, East Side Lenders maintains that the choice
of Delaware law as controlling in the loan documents would be upheld, as all
of the significant contacts in the loan transaction occur in Delaware. The
loan agreement is legal and enforceable. In responding to your
correspondence, East Side Lenders notes and reserves all available legal and
equitable objections to the points you have raised.
East Side Lenders provided this service as a convenience to you. We still
consider your loan to be outstanding and are prepared to go to arbitration

if that's the case then no you at least get a PIF(paid in full).it seems you overpaid already.eastside is a payday loan,and and illegal one at that.they sent me the same thing about arbitration.guess what?i overpaid and got the account closed with a zero balance.again do not pay them another cent.

Starting to here from some of my pdl'ls since the ACH withdrawals were returned "account Closed". It seems they, mainly, Nationwide, 500 FastCash, Integrity advance and Oneclickcash, are ignoring my letter I sent them via e-mail and calling me. Is this typical. Should I answer the calls and refer them to my e-mail correspondence or just say "look, you you can't get blood from a stone, give me a physical address to send payments and I will send you what I borrowed." Please advise. Thanks

One click calls me too. I just hang up on them after telling them they cannot contact me other than USPO. Then I resend the e-mail but I've overpaid them so I requested paid in full letter and refund. You can ask them for a physical address and don't back down. I'm going through that with Eastside; they will not give me an address, they want me to send a moneygram (or whatever). Also, they're asking for amount borrowed plus the fees. I haven't got to the negotiation stage yet with them.

If you hang up on them, reminding them they're not to contact you, and resend your letters, eventually the calls will stop.

Here is an update on my progress. As I mentioned, I sent all of my pdl's a letter similar to the one on here about stopping the ach etc. on 8/14, except one, DJR Group. Since that time I have received a couple calls, none of which were that bad. Nationwide was the only one who read me all the criminal penalties associated with stopping my ach withdrawal, which she called a bounced check. I thanked her for the call and hung up. I'll call her back later. Two others have offered to settle, one I overpaid by $515.00 wants to settle for $150 more. One that I have yet to pay any on a $400 loan offered to settle for $550.00. What would ya'll's advice be on these two offers? I countered back at $460 on the $550 offer, but she said no.

Paul, I figured $460 because in SC they can only charge $15 per $100 lent. But after further thought, that only applies to lenders legally lisinced to lend in SC, correct? I will do as you suggested and let them know once again they are not licensed to lend in SC and I will be paying them $400, nothing more. Thanks for the pep talk!

On PayDay Services, whom I have paid $975 on a $400 loan, I would expect I should tell them to pound sand, they will not receive another cent. Plus demand a PIF. Sound about right?
